RÉSUMÉ DIGEST ACT 540 (SB 147) 2022 Regular Session Mizell Existing law establishes procedures for licensed hospitals and healthcare providers to follow in the event that a person presents himself or herself or is presented for treatment as a victim of a sexually-oriented criminal offense, including the preservation of tests, procedures, and samples that may serve as potential evidence. New law provides that, upon request of a competent adult victim of a sexually-oriented criminal offense, the healthcare provider that performed the forensic medical exam shall provide a reproduction of any written documentation which is in the possession of the healthcare provider resulting from the forensic medical exam of the victim. New law requires the documentation to be provided at no cost to the victim no later than 14 days after the healthcare provider receives the request or the healthcare provider completes the documentation, whichever is later.
