SENATE BILL NO. 181

AIRCRAFT/AVIATION.  Provides for the definition of an airport sponsor and replaces
engineer with sponsor for the approval, inspection, and certification of airport construction
projects. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 2:801 and 809, relative to DOTD and the definition of an airport
3 sponsor; to provide for the approval, inspection, and certification of airport
4 construction projects; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 2:801 and 809 are hereby amended and reenacted to read as follows:
7 §801.  Definitions

9	(6) "Sponsor" means any state agency, city, town, parish, airport
10 authority, or other political subdivision which owns, leases, or controls any
11 airport, landing field, landing strip, seaplane base, helipad, or aid to air
12 navigation.

14	§809.  Inspection
15	A.  The department shall may approve the engineering and construction plans
16 for any proposed projects that are prepared by consultant or contract engineers for
17 any recipient airport authority. The department may inspect the construction of a

1 project at any time to assure project compliance.
2	B.  The department shall may inspect a complete project with the consultant
3 or contract engineer. The engineer sponsor shall certify that construction is in
4 accordance with plans and specifications. The department may inspect a completed
5 project at any time to assure that the project is being maintained in accordance with
6 project specifications and agreements.
7 Section 2. This Act shall become effective upon signature by the governor or, if not
8 signed by the governor, upon expiration of the time for bills to become law without signature
9 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
10 vetoed by the governor and subsequently approved by the legislature, this Act shall become
11 effective on the day following such approval.

Present law provides definitions for terms used in the Airport Construction and Development
Priority Program.
Proposed law adds the definition of the term "sponsor".
Present law provides the department is required to approve the engineering and construction
plans for any proposed projects that are prepared by consultant or contract engineers for any
recipient airport authority.
Present law requires the department to inspect a completed project and the engineer is
required to certify construction is in accordance with plans and specifications.
Proposed law provides the department is permitted but not required to approve the
engineering and construction plans and is not required to inspect a completed project.
Proposed law provides the sponsor shall certify that construction is in accordance with plans
and specifications, not the department.
Effective upon signature of the governor or lapse of time for gubernatorial action.
