Allows groundwater district commission members appointed by certain entities that furnish water for rural or municipal use to be employees of such entities. (gov sig) 1 AN ACT 2 To enact R.S. 42:1123(47), relative to certain members of the boards of commissioners of 3 groundwater districts; to provide for exceptions to the Code of Governmental Ethics; 4 to provide for applicability; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 42:1123(47) is hereby enacted to read as follows: 7 ยง1123. Exceptions 8 This Part shall not preclude: 9 * * * 10 (47) A member of the board of commissioners of a groundwater district 11 who is nominated by an industrial user or by a privately owned entity that 12 furnishes water for rural or municipal use within the district and who is 13 appointed or commissioned by the governor and confirmed by the Senate, all 14 pursuant to law, and who, at the time of nomination, is employed by, rendering 15 compensated services to, or participating in a transaction with the member's 16 respective nominating entity from being employed by, rendering compensated 17 services to, or participating in transactions with the member's respective Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. The provisions of this Act shall be considered remedial and interpretive 3 and shall be applied retroactively and prospectively. 4 Section 3. This Act shall become effective upon signature by the governor or, if not 5 signed by the governor, upon expiration of the time for bills to become law without signature 6 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 7 vetoed by the governor and subsequently approved by the legislature, this Act shall become 8 effective on the day following such approval.
