(8/1/22) 1 AN ACT 2 To amend and reenact R.S. 28:826(A) and (C)(1), and to repeal R.S. 28:826(C)(3), relative 3 to the Community and Family Support System Fund; to change the name of the fund 4 from the Community and Family Support System Fund to the Disability Services 5 Fund; to provide for the purposes of the Disability Services Fund; and to provide for 6 related matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 28:826(A) and (C)(1) are hereby amended and reenacted to read as 9 follows: 10 ยง826. Community and Family Support System Disability Services Fund 11 A. There is hereby created, as a special fund in the state treasury, the 12 Community and Family Support System Disability Services Fund, hereafter 13 sometimes referred to as "the fund." 14 * * * 15 C.(1) Subject to annual appropriation by the legislature, the monies in the 16 Community and Family Support System Disability Services Fund shall be used 17 solely to improve the capacity of the state to meet the varying and complex needs of Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 260 SLS 22RS-519 ORIGINAL 1 individuals with developmental disabilities, with emphasis on increasing the number 2 of recipients of waiver services and no less than fifty percent of the proceeds of the 3 fee assessed pursuant to the provisions of R.S. 40:1046(H)(8)(a) deposited into the 4 fund shall be used to provide funding for the Early Steps intervention program for 5 infants and toddlers with disabilities and their families as established in R.S. 28:461 6 et seq. 7 * * * 8 Section 2. R.S. 28:826(C)(3) is hereby repealed in its entirety. 9 Section 3. The Louisiana State Law Institute is hereby directed to change the name 10 of the Community and Family Support System Fund to the Disability Services Fund 11 wherever it may appear in law. DIGEST SB 260 Original 2022 Regular Session Hewitt Present law creates the Community and Family Support System Fund in the state treasury. Proposed law changes the name of the fund from the Community and Family Support System Fund to the Disability Services Fund. Present law provides that subject to annual appropriation by the legislature, the monies in the fund shall be used solely to improve the capacity of the state to meet the varying and complex needs of individuals with developmental disabilities, with emphasis on increasing the number of recipients of waiver services. Proposed law retains present law except to delete the language about emphasis on increasing the number of recipients of waiver services. Present law provides that no less than 50% of the proceeds of the fee assessed pursuant to the provisions of present law deposited into the fund shall be used to provide funding for the Early Steps intervention program for infants and toddlers with disabilities and their families as established in present law. Proposed law retains present law. Present law provides that for purposes of present law "waiver services" means Medicaid services provided under the New Opportunities Waiver, the Children's Choice Waiver, or any other Medicaid home and community based waiver for persons with developmental disabilities as promulgated by the Dept. of Health and Hospitals, now known as the La. Dept. of Hospitals. Proposed law repeals this provision of present law.
