Present law prohibits certain entities from procuring prohibited telecommunications or video
surveillance equipment or services.
Present law requires vendors, prior to procurement of certain telecommunications or video
surveillance equipment or services, to provide documentation by affidavit that the equipment or
services to be procured are not prohibited telecommunications or video surveillance equipment or
services.
Proposed law requires vendors who supply prohibited equipment to replace the equipment with
nonprohibited equipment at their own expense that is of at least equal quality.
Proposed law requires that vendor documentation required in present law be subject to audit by the
office of the legislative auditor.
Proposed law provides that violation of the provisions of present law relative to procurement of
telecommunication or video surveillance equipment can result in debarment or suspension.
Present law defines "agency" as the boards, commissions, departments, agencies, offices, officers,
and other instrumentalities, or any or all of these, within the executive branch of state government
which are abolished by this Title or which are transferred and placed within departments of the state
government created and established or continued by this Title or transferred to and placed within the
office of the governor as provided by this Title.
Proposed law defines "agency" as any department, office, division, commission, council, board,
bureau, committee, institution, agency, government corporation, or other establishment or official
of the executive branch of state government or any parish, city, town, governmental body, and any
other subdivision of the state or public agency thereof, public authority, public educational, health,
or other institution, and to the extent provided by law, any other entity which expends public funds
for the acquisition or leasing of supplies, services, major repairs, and construction.
Effective August 1, 2022.
