(gov sig) 1 AN ACT 2 To amend and reenact R.S. 4:228(F), relative to horse racing; to provide for offtrack 3 wagering facility locations; to provide for prohibitions; to provide for exceptions; 4 and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 4:228(F) is hereby amended and reenacted to read as follows: 7 ยง228. Offtrack wagering facility locations; prohibited distances; prohibited structures 8 * * * 9 F.(1) If application for licensing is made after July 1, 2021, the prohibition 10 in Subsection A of this Section shall apply. 11 (2) Notwithstanding the prohibitions in Subsections A and D of this 12 Section and Paragraph (1) of this Subsection, if the owner of the equity of the 13 primary licensee on July 1, 2021, sold the equity of the primary licensee to a new 14 owner, and the transaction was approved by the commission prior to 15 November 1, 2021, then the primary licensee shall have until August 1, 2022, to 16 apply for licensing of offtrack wagering facility locations and the prohibitions 17 in Subsections A and D of this Section and Paragraph (1) of this Subsection Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. This Act shall become effective upon signature by the governor or, if not 4 signed by the governor, upon expiration of the time for bills to become law without signature 5 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 6 vetoed by the governor and subsequently approved by the legislature, this Act shall become 7 effective on the day following such approval. DIGEST SB 431 Engrossed 2022 Regular Session Robert Mills Present law prohibits any license be granted to any offtrack wagering facility (OTB) located within one mile from any property on the National Register of Historic Places, any public playground, any residential property, or a building used primarily as a church, synagogue, public library, or school. Present law provides for an exception to the present law prohibition if the OTB licensee applied for a license or was issued a license on or before July 1, 2021, or applied for or was issued a valid building permit on or before July 1, 2021, and subsequently issued a license. Proposed law provides for an exception to the present law prohibition if the owner of the equity of the primary licensee on July 1, 2021, sold the equity of the primary licensee to a new owner, and the transaction was approved by the La. State Racing Comm. prior to November 1, 2021, then the primary licensee shall have until August 1, 2022, to apply for licensing of the OTBs.
