SENATE BILL NO. 458

FLOOD PROTECTION AUTH. Provides relative to the board of commissioners and the
nominating committee of certain flood protection authorities. (gov sig)
1 AN ACT
2 To amend and reenact R.S. 38:330.1(C)(1)(a), and to enact R.S. 38:330.1(C)(2)(a)(xii), and
3 (xiii), relative to flood protection authorities; to provide relative to the board of
4 commissioners of the Southeast Louisiana Flood Protection Authority-East; to
5 provide for the composition of the nominating committee; to provide for an effective
6 date; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 38:330.1(C)(1)(a) is hereby amended and reenacted and R.S.
9 38:330.1(C)(2)(a)(xii) and (xiii) are enacted to read as follows:

11 Louisiana Flood Protection Authority-West Bank; territorial
12 jurisdiction; board of commissioners; appointments; terms;
13 compensation; vacancy; officers; meetings; domicile

15 C.(1) There is hereby created a board of commissioners for each flood
16 protection authority as follows:
17 (a) The board of commissioners of the Southeast Louisiana Flood Protection

1 Authority-East shall be composed of nine members, of whom there shall be at least,
2 and not more than, one member from each parish two members each from
3 Jefferson and St. Bernard parishes, and four members from Orleans Parish
4 who shall reside within the territorial jurisdiction of the authority. The members
5 shall be appointed by the governor from nominations submitted by the nominating
6 committee as follows:
7 (i) Five Four members who shall either be an engineer or a professional in
8 a related field such as geotechnical, hydrological, or environmental science. Of the
9 five four members, one member shall be a civil engineer.
10 (ii) Two Three members who shall be a professional in a discipline other
11 than that occurring in Item (i) of this Subparagraph with at least ten years of
12 professional experience in that discipline.
13 (iii) Two members who shall be at-large.

15 (2)(a) The nominating committee for each board shall be composed as
16 follows:

18 (xii) A faculty member or designee of Dillard University.
19 (xiii) A faculty member or designee of Xavier University of Louisiana.

21 Section 2. This Act shall become effective upon signature by the governor or, if not
22 signed by the governor, upon expiration of the time for bills to become law without signature
23 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
24 vetoed by the governor and subsequently approved by the legislature, this Act shall become
25 effective on the day following such approval.

Present law provides for a nine member board of commissioners of the Southeast Louisiana
Flood Protection Authority-East (SLFPA-E), composed of at least, and not more than, one
member from each parish within the territorial jurisdiction of the authority.
Proposed law requires that the nine member board of commissioners be composed of two
members each from Jefferson and St. Bernard parishes and four members from Orleans
Parish.
Present law provides that five members of the board of commissioners must be an engineer
or a professional in a related field such as geotechnical, hydrological, or environmental
science. Proposed law changes the required number from five to four.
Present law provides that two members of the board of commissioners must be a
professional in a discipline other than an engineer or a professional in a related field as
outlined in present law. Proposed law changes the required number from two to three.
Present law requires a nominating committee for the board of commissioners for the
Southeast La. Flood Protection Authority-East and the Southeast La. Flood Protection
Authority-West Bank to submit nominations to the governor for appointment.
Proposed law retains present law and adds a faculty member or designee of Dillard
University and Xavier University of Louisiana to the nominating committee.
Effective upon signature of the governor or lapse of time for gubernatorial action.
