SENATE BILL NO. 458
BY SENATOR HARRIS 
FLOOD PROTECTION AUTH.  Provides relative to the board of commissioners and the
nominating committee of certain flood protection authorities. (gov sig)
1	AN ACT
2 To amend and reenact the introductory paragraph of R.S. 38:330.1(C)(1)(a) and to repeal
3 R.S. 38:291(W)(2) and R.S. 38:330.1(B)(1)(a)(v), relative to flood protection
4 authorities; to provide relative to the board of commissioners of the Southeast
5 Louisiana Flood Protection Authority-East; to provide for an effective date; and to
6 provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. The introductory paragraph of R.S. 38:330.1(C)(1)(a) is hereby amended
9 and reenacted to read as follows:
10 ยง330.1. Southeast Louisiana Flood Protection Authority-East and Southeast
11	Louisiana Flood Protection Authority-West Bank; territorial
12	jurisdiction; board of commissioners; appointments; terms;
13	compensation; vacancy; officers; meetings; domicile

15	C.(1) There is hereby created a board of commissioners for each flood
16 protection authority as follows:
17	(a) The board of commissioners of the Southeast Louisiana Flood Protection

1 Authority-East shall be composed of nine members, of whom there shall be at least,
2 and not more than, one member from each parish one member from St. Bernard
3 Parish, two members from Jefferson Parish, and three members from Orleans
4 Parish who shall reside within the territorial jurisdiction of the authority. The
5 members shall be appointed by the governor from nominations submitted by the
6 nominating committee as follows:

8 Section 2. R.S. 38:291(W)(2) and R.S. 38:330.1(B)(1)(a)(v) are hereby repealed.
9 Section 3. Each commissioner currently serving on the Southeast Louisiana Flood
10 Protection Authority-East may complete the term for which he was appointed. The
11 commissioners as established by this Act, shall be appointed when a current commissioner
12 resigns, dies, or his term expires.
13 Section 4. This Act shall become effective upon signature by the governor or, if not
14 signed by the governor, upon expiration of the time for bills to become law without signature
15 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
16 vetoed by the governor and subsequently approved by the legislature, this Act shall become
17 effective on the day following such approval.

Present law provides for a nine member board of commissioners of the Southeast Louisiana
Flood Protection Authority-East (SLFPA-E), composed of at least one member from each
parish within the territorial jurisdiction of the authority.
Proposed law requires that the nine-member board of commissioners be composed of at least
one member from St. Bernard Parish, two members from Jefferson Parish, and three
members from Orleans Parish.
Present law includes the Tangipahoa Levee District in the SLFPA-E. Proposed law repeals
present law.
Proposed law provides that current commissioners serve until the end of their term or upon
resignation or death.
Effective upon signature of the governor or lapse of time for gubernatorial action.

(Amends R.S. 38:330.1(C)(1)(a)(intro para); repeals R.S. 38:291(W)(2) and R.S.
38:330.1(B)(1)(a)(v))
Summary of Amendments Adopted by Senate
Committee Amendments Proposed by Senate Committee on Transportation,
Highways, and Public Works to the original bill
1. Requires the nine member board of commissioners be composed of one
member from St. Bernard Parish, two members from Jefferson Parish, and
three members from Orleans Parish.
2. Changes the number of at-large members required from two to three.
3. Removes the Tangipahoa Levee District from the SLFPA-E.
4. Removes the provision changing number of certain professionals required on
the board.
5. Provides that current commissioners serve until the end of their term or upon
resignation or death.
