SENATE BILL NO. 460

COMMERCIAL REGULATIONS.  Provides relative to a statewide electric vehicle charging
technology and equipment network. (gov sig)
1	AN ACT
2 To enact Chapter 15 of the Title 45 of the Louisiana Revised Statues of 1950, to be
3 comprised of R.S. 45:1621 through 1623, relative to electric vehicle charging
4 equipment networks; to provide for legislative intent; to provide terms; to provide
5 for an effective date; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  Chapter 15 of Title 45 of the Louisiana Revised Statutes of 1950,
8 comprised of R.S. 45:1621 through 1623, is hereby enacted to read as follows:
9	CHAPTER 15. ELECTRIC VEHICLE CHARG ING
10	EQUIPMENT NETWORK S
11 §1621. Short Title
12	This Chapter shall be known and may be cited as the "Electric Vehicle
13 Charging Equipment Network Act".
14 §1622. Purpose; legislative intent
15	The Louisiana Legislature hereby finds it necessary and in the best
16 interest of the state to promote rapid development of a statewide electric vehicle
17 charging network by doing the following:

1	(1) Improving the quantity, quality, and variety of electric vehicle
2 charging amenities and consumer experience services available in the state.
3	(2) Urging the Louisiana Public Service Commission to establish an
4 electric vehicle charging rate structure that promotes long-term alternative fuel
5 market competition by encouraging transparent pricing, more stable electricity
6 costs, expanded investment opportunities in charging infrastructure,
7 innovation, and a widespread implementation of publicly available fast
8 charging, electric vehicle charging technology and equipment.
9	(3) Urging the Louisiana Public Service Commission to explore excluding
10 persons or corporations from the definition of public utility when all of the
11 following occur:
12	(a) Those persons or corporations purchase electricity from an electric
13 public utility or a municipal electric utility.
14	(b) Those persons or corporations furnish electricity exclusively to
15 charge battery electric vehicles and plug-in hybrid electric vehicles to or for the
16 public for compensation.
17	(c) Those persons or corporations do not otherwise operate as a public
18 utility.
19 §1623. Definitions
20	As used in this Chapter, the following terms are defined as and mean the
21 following:
22	(1) "Commission" means the Louisiana Public Service Commission.
23	(2) "Electric public utility" for the purposes of sale for resale of power
24 related to electric vehicles, or other activities related to operators of electric
25 vehicle equipment, shall be determined by the commission pursuant to its order
26 issued in Docket R-36131.
27 Section 2. This Act shall become effective upon signature of the governor or, if not
28 signed by the governor, upon expiration of the time for bills to become law without signature
29 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If

1 vetoed by the governor and subsequently approved by the legislature, this Act shall become
2 effective on the day following such approval.

Proposed law creates the "Electric Vehicle Charging Equipment Network Act" for the
purposes of establishing a statewide electric vehicle charging technology and equipment
network.
Proposed law provides that it is the intent of the legislature that proposed law promotes a
rapid development of a statewide electric vehicle charging network.
Proposed law defines "commission" and "electric public utility".
Effective upon signature of the governor or lapse of time for gubernatorial action.
