SENATE BILL NO. 464

MEDICAID.  Provides relative to Medicaid coverage for genetic testing of critically ill
infants with no diagnosis. (8/1/22)
1	AN ACT
2 To enact R.S. 40:1081.12, relative to Medicaid coverage for genetic testing of critically ill
3 infants; to provide for coverage for rapid whole genome sequencing testing of certain
4 infants; to provide for the duties of the secretary of the Louisiana Department of
5 Health; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 40:1081.12 is hereby enacted to read as follows:
8 ยง1081.12.  Medicaid coverage; genetic testing of critically ill infants
9	A.(1)  Subject to the approval of the Centers for Medicare and Medicaid
10 Services, the Louisiana medical assistance program shall include coverage on
11 a fee-for-service basis for rapid whole genome sequencing testing of an infant
12 who is enrolled in a Medicaid managed care plan and meets all of the following
13 criteria:
14	(a)  Is one year of age or younger.
15	(b)  Has a complex illness of unknown etiology.
16	(c)  Is receiving inpatient hospital services in an intensive care unit or in
17 a pediatric care unit.

1	(2)  Coverage provided for the infant pursuant to this Section shall
2 include individual sequencing, trio sequencing of the parents of the infant, and
3 ultra-rapid sequencing.
4	B.  The secretary of the Louisiana Department of Health shall take all
5 actions necessary to implement the provisions of this Section, including but not
6 limited to both of the following:
7	(1) Promulgation of rules and regulations in accordance with the
8 Administrative Procedure Act to provide for Medicaid coverage pursuant to
9 this Section.
10	(2) Submission to the Centers for Medicare and Medicaid Services of any
11 new waiver application, amendment to an existing waiver, or Medicaid state
12 plan amendment to provide for Medicaid coverage pursuant to this Section.
