1 AN ACT
2 To enact R.S. 48:2085, relative to the Louisiana Transportation Authority; to provide for
3 design build projects; to provide for unsolicited proposals; to provide for
4 responsibilities of the Department of Transportation and Development; and to
5 provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 48:2085 is hereby enacted to read as follows:
8 ยง2085. Design build projects; authority
9 Notwithstanding any law to the contrary or the requirements of this
10 Chapter, the authority may accept unsolicited proposals for design build
11 projects in excess of one hundred million dollars. If the authority receives an
12 unsolicited proposal of the design build project, the authority shall notify the
13 department and the department shall review the unsolicited proposal and notify
14 interested bidders by public advertisement throughout the state for a period of
15 thirty days. Interested parties shall submit a formal request of consideration
16 within thirty days. Interested bidders shall be allowed no more than one
17 hundred twenty days to submit an unsolicited proposal including schedule,
18 design, and cost. All proposals for a design build project received pursuant to
19 this Section shall comply with all applicable provisions of law regarding the

1 design build method and the review cost shall be nonrefundable should the
2 project not move forward.
