2022 Regular Session ENROLLED SENATE BILL NO. 68 BY SENATOR FRED MILLS AND REPRESENTATIVES BEAULLIEU, CARRIER, FISHER, LARVADAIN AND MIGUEZ 1 AN ACT 2 To amend and reenact R.S. 51:61, 64, and 65, relative to foreign trade zones; to provide 3 relative to the Port of Iberia; to provide authorization for the port commission to 4 make application to be designated as a foreign trade zone; and to provide for related 5 matters. 6 Notice of intention to introduce this Act has been published. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 51:61, 64, and 65 are hereby amended and reenacted to read as 9 follows: 10 §61. Definitions 11 Whenever used in this Part, "board" refers to the New Orleans Aviation 12 Board, the Board of Commissioners of the Lake Charles Harbor and Terminal 13 District, the South Louisiana Port Commission, the South Tangipahoa Parish Port 14 Commission, the Greater Baton Rouge Port Commission, the Caddo-Bossier Port 15 Commission, the Vidalia Port Commission, the Board of Commissioners of the 16 England Economic and Industrial Development District, the Board of 17 Commissioners of the Port of New Orleans, and the Plaquemines Port, Harbor and 18 Terminal District, the Board of Commissioners of the Port of Iberia and in 19 addition, any port commission or port, harbor, and terminal district, the New Orleans 20 Regional Business Park, and any airport with an industrial park or property 21 designated for industrial development. 22 * * * ACT No. 174 Page 1 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. Buildings or enclosures 2 The board may lease the right to do so or may erect, maintain, and operate 3 any structures, buildings, or enclosures as may be necessary or proper for 4 establishing and operating any foreign trade zones or subzones that may be 5 established in the New Orleans International Airport, the South Louisiana Port 6 Commission, the Lake Charles Harbor and Terminal District, the South Tangipahoa 7 Parish Port Commission, the Greater Baton Rouge Port Commission, the 8 Caddo-Bossier Port Commission, the Vidalia Port Commission, the England 9 Economic and Industrial Development District, the Port of New Orleans, the 10 Plaquemines Port, Harbor and Terminal District, the Board of Commissioners of 11 the Port of Iberia or any port commission or port, harbor, and terminal district, the 12 New Orleans Regional Business Park, and any airport commission with an industrial 13 park or property designated for industrial development under and by virtue of 19 14 U.S.C. §81a et seq. 15 §65. Extent of authority of commissioners 16 The authority granted in this Part to the board confers on the board the right 17 to do all things necessary and proper to carry into effect the establishing, 18 maintaining, and operating of foreign trade zones in the New Orleans International 19 Airport, the South Louisiana Port Commission, the Lake Charles Harbor and 20 Terminal District, the Port of New Orleans, the South Tangipahoa Parish Port 21 Commission, the Caddo-Bossier Port Commission, the Vidalia Port Commission, the 22 England Economic and Industrial Development District, or the Greater Baton Rouge 23 Port Commission, the Plaquemines Port, Harbor and Terminal District, the Board 24 of Commissioners of the Port of Iberia or any port commission or port, harbor, and 25 terminal district, the New Orleans Regional Business Park, and any airport with an 26 industrial park or property designated for industrial development, and to comply 27 fully with the provisions of 19 U.S.C. §81a et seq. and all regulations that may be 28 made under it. Further, a board which that does not have federally authorized foreign 29 trade zone status may enter into agreement with another board which that has 30 federally granted foreign trade zone authority to establish, maintain, or operate a Page 2 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 68 ENROLLED 1 subzone or subzones within the jurisdiction of the board, provided that the agreement 2 shall not limit or affect the powers and authority of either board.
