SLS 22RS-256 REENGROSSED 2022 Regular Session SENATE BILL NO. 80 BY SENATOR WHITE SUPPLEMENTAL PAY. Increases the amount of supplemental pay for eligible law enforcement and fire service employees. (7/1/22) 1 AN ACT 2 To amend and reenact R.S. 13:2591(A)(1), R.S. 40:1666.1(A)(1), (4)(a), and (6)(a), 3 1667.1(A)(1) and (2)(a), 1667.7(B) and (G), and 1667.9, relative to supplemental pay 4 for firemen, police officers, law enforcement officers of certain state agencies and 5 political subdivisions, deputy sheriffs, and full-time deputy sheriffs employed as 6 field representatives or process servers, justices of the peace, constables, harbor 7 police, bridge police, fireboat employees, and certain tribal officers and firemen; to 8 provide for extra compensation for commissioned law enforcement officers 9 employed by a public institution of higher education; to provide certain constables 10 and marshals as provided by law; to provide for extra compensation for certain 11 harbor police officers, fireboat operators, certain tribal officers, and bridge police 12 officers employed by the state; to provide for extra compensation for certain tribal 13 firemen; to provide for extra compensation for certain fire protection officers with 14 the Plaquemines Port Harbor and Terminal District; to provide for an effective date; 15 and to provide for related matters. 16 Be it enacted by the Legislature of Louisiana: 17 Section 1. Amount of additional salary for justices of the peace and constables; 2 payment of expenses at the Justice of the Peace Training Course 3 A.(1) Every justice of the peace and every constable for each justice of the 4 peace court in the state shall be paid by the state an additional salary equal to the 5 amount paid justices of the peace and constables by their respective parishes, in no 6 event to exceed one two hundred dollars per month, provided funds are available and 7 appropriated by the legislature. 8 * * * 9 Section 2. R.S. 40:1666.1(A)(1), (4)(a), and (6)(a), 1667.1(A)(1) and (2)(a), 10 1667.7(B) and (G), and 1667.9 are hereby amended and reenacted to read as follows: 11 §1666.1. Extra compensation 12 A.(1) In addition to the compensation now paid by any municipality, parish, 13 fire protection district, or other political subdivision maintaining a fire department, 14 or by the Chitimacha Tribe of Louisiana or the Coushatta Tribe of Louisiana, 15 hereinafter referred to as "tribe", or by any nonprofit corporation contracting with 16 any such political subdivision to provide fire protection services to every paid, 17 regularly employed employee who is paid not less than three hundred dollars per 18 month, not including supplemental pay, as distinguished from part-time employees 19 and volunteers of such fire department, who are carried on the payroll of such fire 20 department, and every employee as defined herein who is paid from funds of the 21 parish or municipality or tribe obtained through lawfully adopted bond issues, 22 lawfully assessed taxes, or other funds available for such purpose, either directly or 23 through a board or commission set up by law or ordinance of the parish or 24 municipality or tribe, shall be paid extra compensation by the state in the amount of 25 five six hundred dollars per month for each such paid employee who has completed 26 or who hereafter completes one year of service. The provisions of Paragraph (5) of 27 this Subsection shall govern the requirements for length of service for employees 28 who were ordered to active military duty in the armed services of the United States 29 during their initial term of employment. SB NO. 80 SLS 22RS-256 REENGROSSED 1 * * * 2 (4)(a) Every fire protection officer who is employed on a full-time basis by 3 a port authority headquartered in the city of New Orleans shall be paid by the state 4 extra compensation in the amount of five six hundred dollars per month in addition 5 to the compensation now paid to him by his employer out of self-generated revenue 6 attributable to the agency employing such fire protection officers. To be eligible for 7 the extra compensation, each such fire protection officer shall have completed one 8 year of service, and any such fire protection officer hired after March 31, 1986, shall 9 also have completed and passed a certified fireman's training program equal to 10 National Fire Protection Association Standard 1001 Firefighter I Certification or a 11 firemen's training program as approved by the Louisiana State University Firemen 12 Training Program in accordance with R.S. 40:1541 et seq., or other state or federally 13 approved maritime firefighter training program. 14 * * * 15 (6)(a) Every fire protection officer who is employed on a full-time basis by 16 the Plaquemines Port Harbor and Terminal District shall be paid by the state extra 17 compensation in the amount of five six hundred dollars per month in addition to the 18 compensation now paid to him by his employer out of self-generated revenue 19 attributable to the agency employing the fire protection officers. To be eligible for 20 the extra compensation, each fire protection officer shall have completed one year 21 of service, and any fire protection officer hired after March 31, 1986, shall also have 22 completed and passed a certified fireman's training program equal to National Fire 23 Protection Association Standard 1001 Firefighter I Certification or a firemen's 24 training program as approved by the Louisiana State University Firemen Training 25 Program in accordance with R.S. 40:1541 et seq., or other state or federally approved 26 maritime firefighter training program 27 * * * 28 §1667.1. SB NO. 80 SLS 22RS-256 REENGROSSED 1 A.(1) In addition to the compensation now paid by any municipality included 2 in this Part or by the Chitimacha Tribe of Louisiana, the Coushatta Tribe of 3 Louisiana, or the Tunica-Biloxi Tribe of Louisiana, hereinafter referred to as "tribe" 4 or "tribal", to any police officer, every police officer employed by any municipality 5 or tribe which employs one or more police officers who devotes his full working 6 time to law enforcement, and for those hired after March 31, 1986, who have 7 completed and passed a council-certified training program as provided in R.S. 8 40:2405, shall be paid by the state extra compensation in the amount of five six 9 hundred dollars per month for each full-time municipal or tribal law enforcement 10 officer who has completed or who hereafter completes one year of service. 11 (2)(a) Every sworn, commissioned law enforcement officer employed on a 12 full-time basis by a bona fide police agency of the state or its political subdivisions, 13 other than the Department of Public Safety and Corrections and the Department of 14 Wildlife and Fisheries, and headquartered in the city of New Orleans, and who 15 serves the welfare of the public in the capacity of a police officer by providing police 16 services to the general public through effecting arrests, issuing citations, and serving 17 warrants while patrolling levees, waterways, and riverfront areas, or while patrolling 18 bridges that are within the boundaries of the city of New Orleans shall be paid by the 19 state extra compensation in the amount of five six hundred dollars per month in 20 addition to the compensation now paid to him by his employer out of self-generated 21 revenue attributable to the agency employing such officers. To be eligible for the 22 extra compensation, each such law enforcement officer shall have completed one 23 year of service, and any such law enforcement officer hired after March 31, 1986, 24 shall also have completed and passed a council-certified training program, as 25 provided in R.S. 40:2405. 26 * * * 27 §1667.7. Out of the funds appropriated by the legislature for the payment of the 2 extra compensation provided by Subsection A of this Section, there shall be 3 distributed to the sheriff of each parish monthly to pay additional compensation for 4 full-time commissioned deputy sheriffs, and for those hired after March 31, 1986, 5 who have completed and passed a council-approved training program as provided 6 in R.S. 40:2405 and who are paid a salary of not less than three hundred fifty dollars 7 per month, the amount of five six hundred dollars per month for each full-time 8 commissioned deputy sheriff at the completion of one year of service. 9 * * * 10 G. Notwithstanding the provisions of Subsections A and B of this Section, 11 any full-time deputy sheriff employed as a field representative or process server and 12 who is paid a salary of not less than three hundred fifty dollars per month shall be 13 entitled to receive extra compensation in the amount of five six hundred dollars per 14 month at the completion of one year of service. However, to be eligible for such 15 extra compensation, a field representative or process server shall have completed and 16 passed a council-approved training program as provided in R.S. 40:2405. 17 * * * 18 §1667.9. Extra compensation for commissioned full-time harbor police, fireboat 19 personnel, and bridge police 20 In addition to the compensation now paid to any harbor police officer, 21 fireboat operator, and bridge police officer, every harbor police officer, fireboat 22 employee, and bridge police officer who is a full-time employee and who is paid a 23 salary of not less than eight hundred dollars per month and who has completed and 24 passed a post-certified training program as provided in R.S. 40:2405 and who has 25 completed or who hereafter completes one year of service shall be paid by the state 26 extra compensation in the amount of five six hundred dollars per month. The 27 provisions of this Section shall only apply to employees of a political subdivision of 28 the state. 29 Section 3. DIGEST SB 80 Reengrossed 2022 Regular Session White Present law provides for every justice of the peace and every constable for each justice of the peace court to be paid an additional salary of not more than $100 a month. Proposed law increases the additional salary to not more than $200 a month. Present law provides for payment of supplemental pay for firemen, police officers, law enforcement officers of certain state agencies and political subdivisions providing police services within certain municipalities, deputy sheriffs, and full-time deputy sheriffs employed as field representatives or process servers who have completed at least one year of service. Present law provides such payment in the amount of $500/month. Proposed law increases such supplemental pay from $500/month to $600/month. Present law provides for state supplemental pay in the amount of $500/month for every full-time harbor police officer, fireboat employee, and bridge police officer who is paid at least $800/month, completes one year of service, and is post-certified. Provides that such supplemental pay only applies to employees of political subdivisions of the state. Proposed law increases such supplemental pay from $500/month to $600/month. Present law provides for payment of supplemental pay of $500/month for eligible full-time fire protection officers employed by a port authority headquartered in the city of New Orleans. The fire protection officers must complete one year of service and pass a state or federally approved maritime firefighter training program.
