2022 Regular Session ENROLLED SENATE RESOLUTION NO. 191 BY SENATOR MCMATH A RESOLUTION To create and provide for the Legislative Advisory Council on Public Contracts, Works, and Improvements. WHEREAS, the provisions of Louisiana law regarding the letting of public contracts, procurement, claims of subcontractors, and the purchase of materials, supplies, and provisions are vast, comprehensive, and in some instances nearly fifty years old; and WHEREAS, several bills were filed during the 2022 Regular Session of the Legislature as a result of the challenges and obstacles faced by contractors and subcontractors in navigating public works laws; and WHEREAS, it would be beneficial to the legislature to have an advisory council study the matter of public works contract laws, obtain expert testimony and stakeholder input, and provide the Senate Committee on Transportation, Highways, and Public Works with recommendations prior to the convening of the 2023 Regular Session of the Legislature. THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana does hereby establish and provide for the Legislative Advisory Council on Public Contracts, Works, and Improvements to study the matter of public works contract laws, and to propose recommendations, together with specific proposals for legislation, by written report to the Senate and to the David R. Poynter Legislative Research Library as required by R.S. 24:771 and 772, no later than February 1, 2023. BE IT FURTHER RESOLVED that the advisory council shall meet and study Louisiana laws relative to public contracts, works, and improvements and shall consider testimony from experts and stakeholders with experience in civil construction projects. BE IT FURTHER RESOLVED that the advisory council shall consist of the following four members: (1) The chairman of the Senate Committee on Transportation, Highways, and Public Works, who shall serve as the chairman of the advisory council. Page 1 of 2 SR NO. 191 ENROLLED (2) The chairman of the Senate Committee on Agriculture, Forestry, Aquaculture, and Rural Development. (3) One member of the Senate who has experience or interest in civil construction projects, appointed by the president of the Senate. (4) One member of the Senate who has experience or interest in public contracts, appointed by the president of the Senate. BE IT FURTHER RESOLVED that the president may provide the names of his appointees to the staff of the Senate Committee on Transportation, Highways, and Public Works on or before August 1, 2022, and that the committee staff shall provide staff support for the advisory council. BE IT FURTHER RESOLVED the advisory council shall convene for its first meeting no later than September 1, 2022, at the call of the chairman. BE IT FURTHER RESOLVED that a majority of the members of the advisory council shall constitute a quorum for the transaction of business. All official actions of the advisory council shall require the affirmative vote of a majority of the members. BE IT FURTHER RESOLVED that the advisory council shall terminate on the date of the submission of its report or April 10, 2023, whichever occurs first. BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the president of the Senate, the chairman of the Senate Committee on Transportation, Highways, and Public Works, and the chairman of the Senate Committee on Agriculture, Forestry, Aquaculture, and Rural Development.
