Extends the reporting and termination deadlines of the Task Force on Statewide Standards for Clerks of Court Electronic Filing and Records Retention. 1 A RESOLUTION 2 To extend the term of the Task Force on Statewide Standards for Clerks of Court Electronic 3 Filing and Records Retention that was created to determine the feasibility and 4 propriety of clerks of court creating electronic records of original paper documents 5 and the maintenance, preservation, and disposition of original paper documents once 6 converted to electronic record, and propose recommendations, together with specific 7 proposals for legislation. 8 WHEREAS, pursuant to Senate Resolution No. 202 of the 2021 Regular Session of 9 the Louisiana Legislature, the legislature created the Task Force on Statewide Standards for 10 Clerks of Court Electronic Filing and Records Retention; and 11 WHEREAS, the Task Force on Statewide Standards for Clerks of Court Electronic 12 Filing and Records Retention was created to develop statewide standardized electronic filing 13 and records retention procedures, including studying the costs and benefits of such 14 standardized procedures, and studying existing procedures for the management and disposal 15 of paper records, documents, and filings; and 16 WHEREAS, Senate Resolution No. 202 of the 2021 Regular Session of the Louisiana 17 Legislature sets forth that the task force is to study the feasibility and propriety of the 18 electronic filing of legal documents, the electronic filing of documents in the conveyance Page 1 of 3 SR NO. 27 SLS 22RS-626 ORIGINAL 1 and mortgage records, the retention, maintenance, preservation, and disposition of original 2 paper documents once converted to electronic record, public access to all public records, 3 including ease of functionality and viewing, and maintaining the integrity of public records, 4 including original documents, and to propose recommendations, together with specific 5 proposals for legislation, by written report to the legislature no later than February 15, 2022; 6 and 7 WHEREAS, the task force determined that additional time is required to fully study 8 all of the issues related to electronic filing and records retention procedures, the costs and 9 benefits of such standardized procedures, and studying existing procedures for the 10 management and disposal of paper records, documents, and filings, and to prepare and 11 submit its report to the legislature. 12 THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana 13 does hereby extend the Task Force on Statewide Standards for Clerks of Court Electronic 14 Filing and Records Retention created by Senate Resolution No. 202 of the 2021 Regular 15 Session of the Louisiana Legislature. 16 BE IT FURTHER RESOLVED that the task force shall perform the same functions 17 and shall consist of the membership as set forth in Senate Resolution No. 202 of the 2021 18 Regular Session of the Louisiana Legislature. 19 BE IT FURTHER RESOLVED that the Senate of the Legislature of Louisiana does 20 hereby extend the deadline by which the task force is to submit its report to the legislature 21 not later than October 31, 2022. 22 BE IT FURTHER RESOLVED that the task force shall terminate on October 31, 23 2022.
