HOUSE BILL NO. 223

PARKS/RECREATION COMMN:  Provides relative to the Iberville Parish Parks and
Recreation District
1	AN ACT
2To amend and reenact R.S. 33:4569.1(B)(2), relative to Iberville Parish;  to provide relative
3 to the Iberville Parish Parks and Recreation District; to provide relative to the
4 employees of the district; to provide relative to the powers granted to the governing
5 authority of Iberville Parish with respect to such employees; and to provide for
6 related matters.
7	Notice of intention to introduce this Act has been published
8	as provided by Article III, Section 13 of the Constitution of
9	Louisiana.
10Be it enacted by the Legislature of Louisiana:
11 Section 1.  R.S. 33:4569.1(B)(2) is hereby amended and reenacted to read as follows:

16	(2)(a)  The board may appoint, employ, and fix the salary of a full-time
17 director of parks and recreation who shall have such duties and responsibilities as
18 may be determined by the board, and may also employ and fix the salaries, duties,
19 and responsibilities of an assistant director and such additional staff as necessary to
20 operate park and recreational facilities and programs.

1	(b)(i)  Notwithstanding any other provision of law to the contrary, the
2 employees of the district shall become employees of the parish of Iberville upon the
3 adoption of an ordinance by the governing authority of the parish of Iberville.  The
4 ordinance shall provide that any such employee shall be subject to the same
5 administrative rules and regulations as other parish employees and shall be eligible
6 to receive compensation and benefits as provided for other parish employees.
7	(ii)  The provisions of Item (i) of this Subparagraph shall not be construed to
8 require the parish of Iberville to reduce the compensation or benefits of any
9 employee who was formerly employed by the district.
10	(iii)  Any parish employee may provide services to, or on behalf of, the
11 district pursuant to an intergovernmental agreement between the parish of Iberville
12 and the district.

Abstract:  Provides relative to the employees of the Iberville Parish Parks and Recreation
District.
Present law creates and provides for the Iberville Parish Parks and Recreation District as a
body corporate in law with all the powers and rights of a political subdivision.  Authorizes
the district to adopt and implement a parishwide recreation and parks program.  Provides for
district boundaries and provides that the governing authority of Iberville Parish is the
governing authority of the district.
Proposed law retains present law.
Present law provides for the powers and duties of the district, including but not limited to
the following:
(1)To acquire, purchase, lease as lessee, and hold and use any property, immovable,
movable, or mixed, corporeal or incorporeal, or any interest therein, and to sell,
transfer, lease as lessor, and dispose of any property or interest therein at any time
acquired by the board.
(2)To acquire by purchase, lease, or otherwise and to construct, improve, maintain, and
operate park and recreational facilities and to administer programs which it deems
necessary to effectuate the purposes of the district.
(3)To enter into agreements with any person or persons, corporation, association, or
other entity, including public corporations, political subdivisions, municipalities, the

U.S. government and agencies thereof, the state of La. or any of its agencies, or any
combination thereof for the operation of any or all park and recreation properties and
facilities.
(4)To enter into contracts with any public or private entity in carrying out its corporate
objectives, including, but not limited to contracts for construction or acquisition of
property and facilities incident to the purposes of the district.
Proposed law retains present law.
Present law authorizes the board to appoint, employ, and fix the salary of a full-time director
of parks and recreation and to also employ and fix the salaries, duties, and responsibilities
of an assistant director and such additional staff as necessary to operate park and recreational
facilities and programs.
Proposed law retains present law but provides that the employees of the district shall become
employees of Iberville Parish upon the adoption of an ordinance by the parish governing
authority.  Requires that the ordinance provide that the employees are subject to the same
administrative rules and regulations as other parish employees and are eligible to receive
compensation and benefits as provided for other parish employees.  Authorizes any parish
employee to perform services to, or on behalf of, the district pursuant to an
intergovernmental agreement between the parish and the district.
