GAMING: Provides with respect to reporting of gaming revenue 1 AN ACT 2To enact R.S. 27:93(A)(6)(d), relative to reporting of gaming revenue; to provide relative 3 to the distribution of gaming proceeds to the Calcasieu Parish School Board, 4 McNeese State University, and Sowela Technical Institute; to require the Calcasieu 5 Parish School Board, McNeese State University, and Sowela Technical Institute to 6 annually prepare a report to the legislative delegation on gaming proceeds received; 7 and to provide for related matters. 8Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 27:93(A)(6)(d) is hereby enacted to read as follows: 10 ยง93. Authorization of local governing authorities; fees; regulation; local option 11 A. 12 * * * 13 (6) In Calcasieu Parish, in lieu of the admission fees authorized by the 14 provisions of Paragraphs (1) and (10) of this Subsection, the governing authority of 15 the location of the berthing facility may levy a fee not to exceed four and five-tenths 16 percent of the monthly net gaming proceeds from each riverboat located within the 17 jurisdiction of that governing authority; however, this rate may not exceed four and 18 five-tenths percent in the aggregate in those situations in which the site of the 19 riverboat berthing facility is located in the jurisdiction of more than one local 20 governing authority. In setting the fee the governing 2 authority may take into account the capital investment of the riverboat licensee in 3 developing the berthing facility site including but not limited to hotels, convention 4 facilities, and other recreational improvements. In addition to the levy of the fee as 5 provided herein, the parties may contract to establish a minimum annual fee and for 6 the payment of additional amounts to cover infrastructure and other public services; 7 accordingly, the establishment of a minimum fee or the payment of additional 8 amounts shall not be considered when computing the effective rate of the levy of the 9 fee authorized herein. Funds derived from the assessment of the monthly net gaming 10 proceeds shall be allocated as follows: 11 * * * 12 (d) The Calcasieu Parish School Board, McNeese State University, and 13 Sowela Technical Institute shall annually prepare a report no later than February first 14 which shall include the total amount of gaming proceeds received pursuant to 15 Subparagraph (a) of this Paragraph. The report shall be distributed to the members 16 of the legislative delegation no later than February fifteenth of each year. The report 17 shall also include the following: 18 (i) An itemized statement for each expenditure from the total amount of 19 gaming proceeds received by the Calcasieu Parish School Board, McNeese State 20 University, and Sowela Technical Institute. 21 (ii) The cumulative total amount of gaming proceeds received by the 22 Calcasieu Parish School Board, McNeese State University, and Sowela Technical 23 Institute from the parish and not expended or distributed by the Calcasieu Parish 24 School Board, McNeese State University, and Sowela Technical Institute. 25 * * * Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Present law authorizes the governing authority in Calcasieu Parish to levy a fee, in lieu of admission fees, not to exceed four and five-tenths percent of the monthly net gaming proceeds from each riverboat located within the jurisdiction of the governing authority. Provides that the amount of the fee shall be established by contract between the governing authority and the riverboat licensee. Present law further provides that funds derived from the assessment of the monthly net gaming proceeds shall be allocated as follows: (1)One sixth of the amount collected shall be distributed as follows: (a)60% to the Calcasieu Parish School Board. (b)30% to McNeese State University. (c)10% to Sowela Technical Institute. (2)The remaining proceeds of the amount collected shall be retained by the governing authority for any expenditure authorized by law. Proposed law retains present law and requires the Calcasieu Parish School Board, McNeese State University, and Sowela Technical Institute to annually prepare a report no later than February first which includes the total amount of gaming proceeds received pursuant to present law. Requires the report to be distributed to members of the legislative delegation no later than February 15 th of each year. Proposed law further requires the report to include the following: (1)An itemized statement for each expenditure from the total amount of gaming proceeds received by the Calcasieu Parish School Board, McNeese State University, and Sowela Technical Institute. (2)The cumulative total amount of gaming proceeds received by the Calcasieu Parish School Board, McNeese State University, and Sowela Technical Institute from the parish and not expended or distributed by the Calcasieu Parish School Board, McNeese State University, and Sowela Technical Institute.
