PROPERTY/PUBLIC:  Provides for the transfer of certain state property in Tangipahoa
Parish
1	AN ACT
2To amend and reenact Sections 1 and 3 of Act No. 190 of the 2022 Regular Session of the
3 Legislature, relative to the transfer of certain state property in Tangipahoa Parish; to
4 authorize the transfer of certain state property in Tangipahoa Parish; to provide for
5 the property description; to provide for terms and conditions; to provide for an
6 effective date; and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  Sections 1 and 3 of Act No. 190 of the 2022 Regular Session of the
9Legislature are hereby amended and reenacted to read as follows:
10	Section 1.  The commissioner of administration and the secretary of the
11 Department of Children and Family Services, notwithstanding any other provision
12 of law to the contrary, are hereby authorized and empowered to convey, transfer,
13 assign, lease, or deliver any interest, excluding mineral rights, the state may have in
14 and to all or any portion of the following described property, including any
15 improvements thereon, in Tangipahoa Parish to the Town of Amite City:
16	A certain piece and parcel of ground in the Town of Amite, Parish of
17	Tangipahoa, State of Louisiana, fronting One hundred (100) feet on Oak
18	Street and running back between parallel lines  One hundred and fifty (150)
19	feet on Bay Street and being the East One-half of lots 12, 13 and 16 of
20	Square 26 according to plat made by J. H. Alford and being a portion of the
21	same property acquired by vendor from the Heirs of N. N. Saal by act of sale
22	recorded in COB 83 Page 302 of the Conveyance Records of Tangipahoa

1	That certain parcel of ground described as fronting 50 feet on the North line
2	of Oak Street, by a depth of 150 feet between parallel lines, more fully
3	described as beginning at a point on the North line of Oak Street, 250 East
4	of the Southwest corner of Square 26, Town of Amite, Parish of Tangipahoa,
5	State of Louisiana, which point is also the Southeast corner of the legacy to
6	Mrs. Dorothy Thompson; thence North 150 feet; thence East 50 feet; thence
7	South 150 feet; thence West 50 feet to point of beginning; said Lot bounded
8	North by Schilling, South by Oak Street, East by Tangipahoa Parish Welfare
9	Department and West by Mrs. Dorothy Thompson.

11	Section 3.  If an agreement authorized by this Act is not entered into by
12 December 31, 2023 2025, the commissioner of administration and the secretary of
13 the Department of Children and Family Services are authorized to proceed with a
14 sale of the property described in this Act in accordance with the procedures set forth
15 in Title 41 of the Louisiana Revised Statutes of 1950.

17 Section 2.  This Act shall become effective upon signature by the governor or, if not
18signed by the governor, upon expiration of the time for bills to become law without signature
19by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
20vetoed by the governor and subsequently approved by the legislature, this Act shall become
21effective on the day following such approval.

Abstract:  Amends prior authorization for the transfer of state property to include a parking
lot adjacent to the tract included in the original authorization.
Present law (Acts 2022, No. 190) authorizes the commissioner of administration and the
secretary of the Dept. of Children and Family Services to transfer certain state property in
Tangipahoa Parish to the Town of Amite City.  Present law provides a property description
and requires the reservation of mineral right to the state.
Proposed law retains present law but amends the property description to include an
additional tract adjacent to the property contained in the original authorization that the
parties intended to include in the original authorization.

Present law further authorizes the state to proceed with a public sale of the property under
the provisions of Title 41 after Dec. 31, 2023, if an agreement between the parties has not
been reached.
Proposed law changes the date for this additional authorization from Dec. 31, 2023 to Dec.
31, 2025.
Effective upon signature of governor or lapse of time for gubernatorial action.
