INSURANCE/AUTOMOBI LE: Provides for a premium discount for certain military personnel 1 AN ACT 2To amend and reenact R.S. 22:1482(A), (B), and (C)(introductory paragraph) and (1), 3 relative to premium discounts on automobile insurance policies for servicemen of the 4 Louisiana Air National Guard and Louisiana Army National Guard; to provide for 5 premium discounts; to require insurers to provide a premium discount on automobile 6 insurance policies to personnel serving in the Louisiana Air National Guard and 7 Louisiana Army National Guard; and to provide for related matters. 8Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 22:1482(A), (B), and (C)(introductory paragraph) and (1) are hereby 10amended and reenacted to read as follows: 11 ยง1482. Military personnel premium discount; rebates; rating standards and methods 12 A. Beginning on July 1, 2006, and thereafter, every Every motor vehicle 13 insurer authorized to transact business in this state shall provide to active duty 14 military, Louisiana Air National Guard, and Louisiana Army National Guard 15 personnel based in this state a discount of twenty-five percent of the premium on any 16 automobile liability insurance policy purchased in this state to cover motor vehicles 17 owned by such military personnel. 18 B. HLS 23RS-470 ENGROSSED HB NO. 369 1 taxes imposed under R.S. 22:838 and 831 in an amount equal to the discount actually 2 provided. To the extent an insurer's credit authorized in this Section exceeds the 3 insurer's premium tax liability, the amount of credit not used to offset premium taxes 4 due shall be considered overpaid taxes and shall be refundable to the insurer, without 5 interest. Such insurers shall submit to the commissioner of insurance the documents, 6 evidence, and proof required, in accordance with the rules and regulations adopted 7 by the commissioner, to establish the discounts actually provided. 8 C. The commissioner of insurance shall adopt rules and regulations, in 9 accordance with the Administrative Procedure Act, to implement the provisions of 10 this Section.
