LIABILITY/CIVIL:  Provides relative to liability associated with parades
Report rejects Senate amendments which would have:
1. Specified that loss sustained is limited to the duration of the parade.
2. Deleted festivities, fairs, and festivals.
3. Deleted ethnic parades.
Report amends the bill to:
1. Change the section heading for R.S. 9:2796.
Digest of the bill as proposed by the Conference Committee
Present law (R.S. 9:2796(A)) provides a limitation of liability for Mardi Gras krewes and
organizations and traditional Courir de Mardi Gras, or any member thereof, and nonprofit
organizations which sponsor fairs or festivals that present parades or courirs for any loss or damage
caused by any member thereof in conjunction with the parade or courir unless the loss or damage
was caused by the deliberate and wanton act or gross negligence of the krewe or organization or
member thereof.
Proposed law retains present law and adds provisions of present law (R.S. 9:2796.1) relative to St.
Patrick's Day parades to proposed law (R.S. 9:2796(C)).
Present law (R.S. 9:2796.1) provides that no person shall have a cause of action against any
organization which presents St. Patrick's Day parades or other street parades connected with any
ethnic celebration. Proposed law repeals present law.
