MEDICAID:  Provides relative to Medicaid coverage for the Psychiatric Collaborative Care
Model
1	AN ACT
2To enact R.S. 40:1259.1, relative to Medicaid coverage for mental health and substance
3 abuse services; to provide for definitions; to provide for insurance coverage for
4 Medicaid recipients via the Psychiatric Collaborative Care Model; and to provide for
5 related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 40:1259.1 is hereby enacted to read as follows: 
8 ยง1259.1.  Psychiatric Collaborative Care Model; Medicaid coverage; service
9	delivery method requirements
10	A.  The state Medicaid program shall provide coverage for mental health and
11 substance abuse services that are delivered through evidence-based, integrated
12 behavioral healthcare models, such as the Psychiatric Collaborative Care Model.
13	B.(1)  Any medical necessity determination made for a recipient of Medicaid
14 services shall be in compliance with the provisions set forth in the Medicaid
15 program, as provided for in Title XIX of the Social Security Act, the Mental Health
16 Parity and Addiction Equity Act, and in accordance with the rules promulgated by
17 the Louisiana Department of Health.
18	(2)  The Louisiana Department of Health shall promulgate rules, in
19 accordance with the Administrative Procedure Act, as needed to comply with the
20 requirements set forth in this Section.

1	C.  As used in this Section, the following terms have the meanings ascribed
2 to them:
3	(1)  "Medicaid" means the medical assistance program provided for in Title
4 XIX of the Social Security Act.
5	(2)  "Mental health or substance abuse services" means services for the
6 treatment of any condition or disorder that involves a mental health condition or
7 substance use disorder that falls under any of the diagnostic categories listed in the
8 mental disorders section of the current edition of the International Classification of
9 Diseases or that is listed in the mental disorders section of the most recent version
10 of the Diagnostic and Statistical Manual of Mental Disorders.
11	(3)  "Psychiatric Collaborative Care Model" means the evidence-based,
12 integrated behavioral health service delivery method that is typically provided by a
13 primary care team consisting of a primary care provider and a care manager who
14 works in collaboration with a psychiatric consultant, such as a psychiatrist.  Care is
15 directed by the primary care team and includes structured care management with
16 regular assessments of clinical status using validated tools and modification of
17 treatment as appropriate.  The psychiatric consultant provides regular consultations
18 to the primary care team to review the clinical status and care of patients and to make
19 recommendations.

Medicaid services to comply with the provisions set forth in present law and the rules
promulgated by the Louisiana Department of Health.
