MTR VEHICLE/LICEN PLATES: Provides relative to fees charged for certain military honor license plates and the processing of plates at the office of motor vehicle state headquarters 1 AN ACT 2To amend and reenact R.S. 47:490.9(B), 490.11(B), 490.13(B), 490.14(B), and 505(B)(2), 3 relative to the office of motor vehicles; to remove fees and renewal requirements for 4 certain military honor plates; to require notification of plate removals; and to provide 5 for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 47:490.9(B), 490.11(B), 490.13(B), 490.14(B), and 505(B)(2) are 8hereby amended and reenacted to read as follows: 9 §490.9. Military honor license plates; World War II veterans 10 * * * 11 B. The charge for this license plate shall be the regular motor vehicle 12 registration license fee as provided for under the provisions of R.S. 47:463. No fee 13 shall be charged for the military honor license plates authorized by this Section, and 14 such plates shall not be subject to the renewal requirements applicable to standard 15 plates. 16 * * * 17 §490.11. Veterans applying for the plates shall present to the issuing 3 official a certified copy of their discharge from active service with one of the armed 4 forces of the United States. The charge for the license plate shall be the regular 5 motor vehicle registration license fee. No fee shall be charged for military honor 6 license plates authorized by this Section, and such plates shall not be subject to the 7 renewal requirements applicable to standard plates. 8 * * * 9 §490.13. Military honor license plates for veterans of the Vietnamese Conflict 10 * * * 11 B. The license plates shall be issued in the same manner as other motor 12 vehicle license plates. Retired members of the armed services of the United States 13 applying for the plates shall present to the issuing official a copy of their active duty 14 retirement orders or other proof of retirement from active service with one of the 15 armed forces of the United States. Veterans of the armed services of the United 16 States who are not retired shall present to the issuing official a copy of their 17 discharge from active service with one of the armed forces of the United States. The 18 charge for the military honor license plate shall be the regular motor vehicle 19 registration license fee. Number plates 8 * * * 9 B. 10 * * * 11 (2) Any dealer of motor vehicles who receives a lease return or a previously 12 owned vehicle with the intention of reselling such vehicle shall remove the license 13 or number plate from such vehicle before resale and destroy the plate. After the 14 dealer so removes the plate, he shall submit electronic notification to the Department 15 of Public Safety and Corrections, which states he has received the vehicle, removed 16 the license or number plate from such vehicle, and intends to resell the vehicle. The 17 dealer shall attach the title and registration to the electronic notification. He shall 18 electronically notify the secretary promptly upon the removal monthly of all plates 19 so removed and destroyed. The Department of Public Safety and Corrections, upon 20 receipt of the electronic notification of a transfer on such vehicle, shall issue a new 21 plate to the new owner in the same manner as if the vehicle had no plate issued to it. 22 The knowing submission of a false electronic notification shall be false swearing 23 under R.S. 14:125. 24 * * * 25 Section 2. The Department of Public Safety and Corrections, office of motor 26vehicles shall promulgate and adopt, in accordance with the Administrative Procedure Act, 27any rules and regulations necessary to bring existing rules in conformity with the provisions 28of this Act. Proposed law removes provisions in present law that specify that the charge for the plate is the same as regular license plates and instead specifies that no fee can be charged for such plates. Further specifies that such plates are not subject to the renewal requirements applicable to standard plates. Present law (R.S.505(B)(2)) requires any dealer of motor vehicles who receives a lease return or previously owned vehicle with the intention of reselling such vehicle must remove the license or number plate from the vehicle before resale. Requires the dealer attach the title and registration to the electronic notification and electronically notify the secretary monthly of all plates so removed and destroyed. Proposed law modifies present law by requiring the dealer destroy the plate. Changes the monthly notification requirement to promptly upon the removal. Proposed law requires the secretary promulgate rules and regulations as necessary to implement the provisions of proposed law.
