MTR VEHICLE/LICEN PLATES:  Provides relative to fees charged for certain military
honor license plates and the processing of plates at the office of motor vehicles state
headquarters
1	AN ACT
2To amend and reenact R.S. 47:490.9(B), 490.11(B), 490.13(B), 490.14(B), and 505(B)(2),
3 relative to the office of motor vehicles; to remove fees and renewal requirements for
4 certain military honor plates; to require notification of plate removals; and to provide
5 for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 47:490.9(B), 490.11(B), 490.13(B), 490.14(B), and 505(B)(2) are
8hereby amended and reenacted to read as follows:
9 §490.9.  Military honor license plates; World War II veterans

11	B.  The charge for this license plate shall be the regular motor vehicle
12 registration license fee as provided for under the provisions of R.S. 47:463.  No fee
13 shall be charged for the military honor license plates authorized by this Section, and
14 such plates shall not be subject to the renewal requirements applicable to standard
15 plates.

1 §490.11.  Military honor license plates for Laos War veterans

3	B.  The license plates shall be issued in the same manner as other motor
4 vehicle license plates.  Veterans applying for the plates shall present to the issuing
5 official a certified copy of their discharge from active service with one of the armed
6 forces of the United States.  The charge for the license plate shall be the regular
7 motor vehicle registration license fee.  No fee shall be charged for military honor
8 license plates authorized by this Section, and such plates shall not be subject to the
9 renewal requirements applicable to standard plates.

11 §490.13.  Military honor license plates for veterans of the Vietnamese Conflict

13	B.  The license plates shall be issued in the same manner as other motor
14 vehicle license plates.  Retired members of the armed services of the United States
15 applying for the plates shall present to the issuing official a copy of their active duty
16 retirement orders or other proof of retirement from active service with one of the
17 armed forces of the United States.  Veterans of the armed services of the United
18 States who are not retired shall present to the issuing official a copy of their
19 discharge from active service with one of the armed forces of the United States.  The
20 charge for the military honor license plate shall be the regular motor vehicle
21 registration license fee.  No fee shall be charged for military honor license plates
22 authorized by this Section, and such plates shall not be subject to the renewal
23 requirements applicable to standard plates.

2 States who are not retired shall present to the issuing official a copy of their
3 discharge from active service with one of the armed forces of the United States.  The
4 charge for this license plate shall be the same as for regular license plates.  No fee
5 shall be charged for military honor license plates authorized by this Section, and such
6 plates shall not be subject to the renewal requirements applicable to standard plates.

12	(2)  Any dealer of motor vehicles who receives a lease return or a previously
13 owned vehicle with the intention of reselling such vehicle shall remove the license
14 or number plate from such vehicle before resale and destroy the plate.  After the
15 dealer so removes the plate, he shall submit electronic notification to the Department
16 of Public Safety and Corrections, which states he has received the vehicle, removed
17 the license or number plate from such vehicle, and intends to resell the vehicle.  The
18 dealer shall attach the title and registration to the electronic notification.  He shall
19 electronically notify the secretary within twenty-four hours after the removal
20 monthly of all plates so removed and destroyed.  The Department of Public Safety
21 and Corrections, upon receipt of the electronic notification of a transfer on such
22 vehicle, shall issue a new plate to the new owner in the same manner as if the vehicle
23 had no plate issued to it.  The knowing submission of a false electronic notification
24 shall be false swearing under R.S. 14:125.

26 Section 2.  The Department of Public Safety and Corrections, office of motor
27vehicles shall promulgate and adopt, in accordance with the Administrative Procedure Act,
28any rules and regulations necessary to bring existing rules in conformity with the provisions
29of this Act.

Abstract:  Removes the registration fee and renewal requirements for military honor
licenses plates for veterans of World War II, the Laos War, the Vietnamese Conflict,
and the Korean War.
Present law (R.S. 47:490.9(B)) specifies that the charge for the World War II license plates
is the regular motor vehicle fee.
Present law (R.S. 47:490.11(B)) requires veterans applying for the Laos War license plate
to present to the issuing official a certified copy of their discharge from active service with
one of the armed forces of the U.S.  Specifies that the charge for the license plate is the
regular motor vehicle registration license fee.
Present law (R.S. 490.13(B)) requires license plates be issued in the same manner as other
motor vehicle license plates.  Requires retired members of the armed services of the U.S.
applying for the plates present to the issuing official a copy of their active duty retirement
orders or other proof of retirement from active service with one of the armed forces of the
U.S.  Requires veterans of the armed services of the U.S. who are not retired present to the
issuing official a copy of their discharge from active service with one of the armed forces
of the U.S.  Specifies that the charge for this license plate is the same for regular license
plates.

U.S.  Requires veterans of the armed services of the U.S. who are not retired present to the
issuing official a copy of their discharge from active service with one of the armed forces
of the U.S.  Specifies that the charge for this license plate is the same for regular license
plates.
Proposed law removes provisions in present law that specify that the charge for the plate is
the same as regular license plates and instead specifies that no fee can be charged for such
plates.  Further specifies that such plates are not subject to the renewal requirements
applicable to standard plates.
Present law (R.S.505(B)(2)) requires any dealer of motor vehicles who receives a lease
return or previously owned vehicle with the intention of reselling such vehicle must remove
the license or number plate from the vehicle before resale.  Requires the dealer attach the
title and registration to the electronic notification and electronically notify the secretary
monthly of all plates so removed and destroyed.
Proposed law modifies present law by requiring the dealer destroy the plate.  Changes the
monthly notification requirement to within 24 hours.
Proposed law requires the secretary promulgate rules and regulations as necessary to
implement the provisions of proposed law.
