[R.S. 1:13(B) and 24:177(E)] HB 536 Original 2023 Regular Session Goudeau Abstract: Amends an affirmative defense to the crime of illegal possession of stolen firearms in regards to the offender's knowledge of the firearm's legality. Present law (R.S. 14:69.1) provides for the crime of illegal possession of stolen firearms and provides for penalties. Proposed law retains present law. Present law (R.S. 14:69.1(A)(2)) provides it shall be an affirmative defense to prosecution that the offender had no knowledge that the firearm was the subject of any form of misappropriation. Proposed law amends present law to provide that it shall no longer be an affirmative defense that the offender had no knowledge that the firearm was the subject of any form of misappropriation.
