[R.S. 1:13(B) and 24:177(E)] HB 567 Original 2023 Regular Session St. Blanc Abstract: Provides for vehicles transporting raw materials used for the production of concrete or asphalt an increased weight allowance of 13.5%. Proposed law allows for an increased weight allowance of 13.5% above the gross vehicle weight allowance in present law (R.S. 32:381). Proposed law conditions the additional weight allowance on the vehicle being actively engaged in transporting material used in the production of concrete or asphalt; and excepts bridge weight limits established by the Dept. of Transportation and Development (DOTD) and interstate highways or other roadways designated by the DOTD as not suitable for such weight allowance. Proposed law requires the DOTD to establish rules and regulations for the implementation of this Section including permitting, fees, and inspection and enforcement procedures. Proposed law provides that weight allowance in proposed law (R.S. 32:387.20(H)) cannot be construed to authorize vehicles to exceed federal weight limits. Present law provides for trucks hauling concrete or construction aggregates to not be assessed a penalty for weights in excess of the maximum allowed axle weight, if the truck does not exceed maximum permissible weight allowed under present law and if the truck is not operating on the interstate. Proposed law adds construction materials, including, but not limited to, concrete pipe and concrete precast and prestressed products to the present law requirement that no penalty be assessed for weights in excess of the maximum allowed axle weight.
