ENROLLED 2023 Regular Session HOUSE BILL NO. 654 (Substitute for House Bill No. 530 by Representative McKnight) BY REPRESENTATIVE MCKNIGHT 1 AN ACT 2 To enact R.S. 49:316.2, relative to state agencies; to provide relative to electronic payments; 3 to provide relative to fees associated with electronic signatures; to provide for the 4 authorization of the collection of fees by the state; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 49:316.2 is hereby enacted to read as follows: 7 ยง316.2. Payments for electronic signatures; authorizations; fees 8 A. The state, through any department, agency, board, commission, or other 9 state entity hereinafter referred to as "state entity" may charge a fee for use of an 10 electronic signature in connection with official documents. The state may accept 11 payment for use of an electronic signature by credit cards, debit cards, and any other 12 form of electronic payments approved by the treasurer as provided in R.S. 49:316.1. 13 B. The fee charged by the state for the use of an electronic signature pursuant 14 to this Section shall be a convenience fee paid directly to the state entity. The amount 15 of the convenience fee, after review and recommendation by the treasurer, shall be 16 approved by the Senate Committee on Revenue and Fiscal Affairs and the House 17 Committee on Ways and Means. In addition, the amount of the convenience fee 18 shall be disclosed to the signatory before the transaction is completed, and the 19 signatory shall be given the option of proceeding without the electronic signature at 20 that time. This Act shall become effective upon signature by the governor or, if not 2 signed by the governor, upon expiration of the time for bills to become law without signature 3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 4 vetoed by the governor and subsequently approved by the legislature, this Act shall become 5 effective on the day following such approval.
