HEALTH/LDH: Directs the Louisiana Department of Health to amend its administrative
rule relative to the geographic location of a hospice provider
1 A RESOLUTION
2To direct the Louisiana Department of Health to amend its administrative rule, LAC
3 48:I.12526(B), regarding the geographic location of a hospice provider within a
4 fifty-mile radius of the hospice proposed geographic location.
5 WHEREAS, LAC 48:I.12526(A) establishes that a hospice provider is eligible to be
6licensed by the Louisiana Department of Health upon meeting all of the requirements for
7licensure; and
8 WHEREAS, LAC 48:I.12526(B) provides that the service area for a proposed or
9existing hospice provider is within a fifty-mile radius of the proposed geographic location
10where the provider is or will be licensed; and
11 WHEREAS, the fifty-mile radius of the proposed geographic location places an
12undue burden on hospice providers who would serve patients where part of the parish is
13within the fifty-mile radius of the proposed geographic location, but the hospice provider is
14not able to service the entire parish; and
15 WHEREAS, the fifty-mile radius of the proposed geographic location also places an
16undue burden on rural areas where a fifty-mile radius may be difficult to define.
17 THEREFORE, BE IT RESOLVED that the House of Representatives of the
18Legislature of Louisiana does hereby direct the Louisiana Department of Health to amend
19its administrative rule regarding the geographic location of a hospice provider to authorize
20such providers to serve patients in any parish within a fifty-mile radius of their location.

1 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
2secretary of the Louisiana Department of Health.
