HLS 23RS-3030 ORIGINAL 2023 Regular Session HOUSE RESOLUTION NO. 204 BY REPRESENTATIVE MAGEE CLERKS OF COURT: Requests the Louisiana Clerks' Remote Access Authority to provide information regarding integrated e-filing and case management 1 A RESOLUTION 2To urge and request the Louisiana Clerks' Remote Access Authority to compile information 3 regarding integrated electronic filing and case management capabilities and to 4 submit a report containing such information to the legislature no later than January 5 1, 2024. 6 WHEREAS, the Louisiana Clerks' Remote Access Authority (LCRAA) has been 7tasked by the legislature as the entity responsible for designing, constructing, administering, 8and maintaining a statewide portal of records maintained by parish clerks of court; and 9 WHEREAS, since 2014, LCRAA has made significant progress in developing the 10statewide portal and providing assistance to parishes to implement electronic filing and case 11management systems; and 12 WHEREAS, to fully modernize Louisiana's judicial system, the state requires a 13statewide integrated electronic filing system that allows for electronic document filing, case 14management, and document and image management; and 15 WHEREAS, many surrounding states, including Georgia, Texas, Florida, and 16Alabama have implemented statewide integrated electronic filing systems; and 17 WHEREAS, integrated electronic filing provides litigants, courts, and the public with 18instant access to court documents allowing for greater transparency and efficiency in our 19judicial system; and Page 1 of 3 HLS 23RS-3030 ORIGINAL HR NO. 204 1 WHEREAS, integrated electronic filing improves access to court systems by 2providing litigants with twenty-four hour access and a secure and standard means by which 3to file and review pleadings; and 4 WHEREAS, recognizing the costs associated with statewide integrated electronic 5filing in Louisiana, in order to make decisions regarding future legislation and funding 6necessary for implementation, the legislature desires more information about the current 7status of all systems of the clerks of court across the state. 8 THEREFORE, BE IT RESOLVED that the House of Representatives of the 9Legislature of Louisiana does hereby urge and request LCRAA to compile the following 10information regarding integrated electronic filing and case management capabilities and to 11submit a report containing such information to the legislature no later than January 1, 2024: 12 (1) The status of implementation of an electronic filing system by each parish clerk 13of court. 14 (2) The status of implementation of an electronic case management system by each 15parish clerk of court. 16 (3) The status of implementation of a document and image management system by 17each parish clerk of court. 18 (4) The case management system or docket system software and software vendor 19used by each parish clerk of court. 20 (5) The number and percentage of remote electronic filings and physical filings of 21pleadings converted to electronic image by each parish clerk of court. 22 (6) The capability of the case management system or docket system of each parish 23clerk of court to accept electronic signatures by judges and the extent of the use of electronic 24signature systems by judges of each court. 25 (7) The costs charged by each clerk of court to persons for electronic filing of civil 26and criminal pleadings and the amounts charged to access, view, and download images of 27pleadings via an electronic case management system or docket system. 28 (8) The costs charged by each clerk of court for electronic recording of documents 29effecting land titles. Page 2 of 3 HLS 23RS-3030 ORIGINAL HR NO. 204 1 (9) The cost charged by each clerk of court to access, view, or obtain copies of 2electronic images or paper copies of electronic images of documents in the land title 3database. 4 (10) The amount of funding necessary to complete an integrated electronic filing 5system for each parish clerk of court. 6 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 7executive director of LCRAA. 8 BE IT FURTHER RESOLVED that the Louisiana Clerks' Remote Access Authority 9shall submit one print copy and one electronic copy of any report produced pursuant to this 10Resolution to the David R.
