ACT 243 (SB 117) 2023 Regular Session	Harris
Existing law provided for imprisonment of not less than one year nor more than five years,
with or without hard labor, and without benefit of suspension of sentence, for whoever
commits an assault by drive-by shooting.
New law increases the penalty from not less than one year to not less than three years
imprisonment, and from not more than five years to not more than 10 years imprisonment,
with or without hard labor, and without benefit of suspension of sentence.
Existing law defines the term "drive-by shooting" as the discharge of a firearm from a motor
vehicle on a public street or highway with the intent either to kill, cause harm to, or frighten
another person.
New law retains existing law but adds "interstate highway" to the definition of "drive-by
shooting".
Effective August 1, 2023.
