DIGEST SB 172 Original 2023 Regular Session Allain Proposed law prohibits the restraint of the practice of medicine through contracts, agreements, or provisions that prevent the physician from practicing following the acquisition of a health care facility or change of ownership. Proposed law defines acquisition and health care provider entity. Proposed law states it is the intent of the legislature that these provisions shall apply prospectively; however, if the court rules that the contract or agreement, or provision thereof is adhesionary, the provisions of this Act shall apply retroactively.
