(8/1/23) 1 AN ACT 2 To amend and reenact the introductory paragraph of R.S. 39:112(E)(2) and 122(A)(1), 3 relative to the capital outlay process; to provide relative to matching fund 4 requirements for non-state entity projects; to provide relative to the obligation of 5 funds for ongoing projects in the capital outlay act; and to provide for related 6 matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. The introductory paragraph of R.S. 39:112(E)(2) and 122(A)(1) are hereby 9 amended and reenacted to read as follows: 10 §112. SB NO. 77 SLS 23RS-123 ORIGINAL 1 A.(1) No work shall commence and no contract shall be entered into for any 2 project contained in the capital outlay act unless and until funds are available from 3 the cash sources indicated in the act or from the sale of bonds or from a line of credit 4 approved by the State Bond Commission, except for funds that are received as 5 supplemental funds for ongoing projects for which contracts have been issued 6 and contracts for Department of Transportation and Development projects which are 7 subject to the provisions of R.S. 48:251(D). 8 * * * The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Curry Lann. DIGEST SB 77 Original 2023 Regular Session Reese Present law requires a match of not less than twenty-five percent of the total requested amount of funding for non-state entity capital outlay projects with certain exceptions. Proposed law requires a match of not less than twenty-five percent of the total project cost for non-state entity capital outlay projects and otherwise retains present law. Present law prohibits the commencement of work and contracting for any project contained in the capital outlay act unless and until funds are available from the cash sources indicated in the act or from the sale of bonds or from a line of credit approved by the State Bond Commission, except for certain contracts for Department of Transportation and Development projects. Proposed law adds an exception for funds that are received as supplemental funds for ongoing projects for which contracts have been issued and otherwise retain present law. Effective August 1, 2023.
