(gov sig) 1 AN ACT 2 To enact R.S. 33:9352(D) and (E), relative to certain veterans' memorial districts; to provide 3 relative to powers and duties of the board of commissioners and the regional military 4 museum foundation; to provide for an effective date; and to provide for related 5 matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 33:9352(D) and (E) are hereby enacted to read as follows: 8 ยง9352. Board of commissioners; membership; meetings 9 * * * 10 D. Notwithstanding any other law to the contrary, the board of 11 commissioners of a veterans' memorial district in a parish with a population 12 between one hundred five thousand and one hundred fifteen thousand, based 13 on the latest federal decennial census, shall have the powers and duties of a 14 veterans' memorial district governing body as provided by law, with its primary 15 purpose to supply a regional military museum and veterans memorial park, 16 except that approval of the parish council shall first be obtained prior to any of 17 the following actions by the board: Page 1 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. Notwithstanding any other law to the contrary, in a parish with a 8 population between one hundred five thousand and one hundred fifteen 9 thousand, based on the latest federal decennial census, the regional military 10 museum foundation shall have the sole power to administer, operate, and 11 maintain the regional military museum. 12 Section 2. This Act shall become effective upon signature by the governor or, if not 13 signed by the governor, upon expiration of the time for bills to become law without signature 14 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 15 vetoed by the governor and subsequently approved by the legislature, this Act shall become 16 effective on the day following such approval. DIGEST SB 92 Engrossed 2023 Regular Session Fesi Present law provides that the governing authority of any parish is authorized and empowered, upon its own initiative, to form and create a veterans' memorial district within the parish. However, an incorporated municipality shall only be included within the territory of a veterans' memorial district upon the concurrence by resolution of the governing authority of the municipality in its inclusion and in the boundaries of the district. The parish governing authority is further authorized to alter the boundaries of any veterans' memorial district; however, no such boundary change shall cause an impairment of the obligations of the veterans' memorial district. Proposed law retains present law but provides relative to a board of commissioners of a veterans' memorial district in a parish with a population between 105,000 and 115,000, based on the latest federal decennial census. The board shall have the powers and duties of a veterans' memorial district governing body as provided by law, with its primary purpose to supply in the parish a regional military museum and veterans memorial park, except that approval of the parish council shall first be obtained prior to any of the following actions by the board: (1) Adoption of an annual budget.
