Urges and requests the entities that approve certain incurrence of debt, appropriation of capital outlay, or a rate adjustment to consider an applicant's compliance status with appropriate regulatory bodies and financial status with the legislative auditor as a component of their review process. 1 A RESOLUTION 2 To urge and request the State Bond Commission, the division of administration, and rate 3 setting authorities to request and consider an applicant's sewerage system compliance 4 status with the Louisiana Department of Health and the Department of 5 Environmental Quality and financial status with the legislative auditor as a 6 component of their review process. 7 WHEREAS, community sewerage systems are a major element of public 8 infrastructures and essential for everyday life, with wastewater treatment facilities in North 9 America processing approximately sixty gallons per person, per day; and 10 WHEREAS, even though community sewerage systems are critical components to 11 our society and public health, aging and outdated systems may have fallen into a state of 12 disrepair over the years due to lack of maintenance and needed upgrades and expanded 13 capacity; and 14 WHEREAS, community sewerage systems needing extensive repairs or upgrades can 15 become too costly to maintain and this can lead to less effective treatment or infrastructure 16 failures such as leakage causing unnecessary pollution; and 17 WHEREAS, it is important that Louisiana residents can be assured that the quality 18 of sewage treatment is monitored and maintained at levels essential for health, safety, Page 1 of 2 SR NO. 104 SLS 23RS-1619 ORIGINAL 1 welfare, and long-term sustainability; and 2 WHEREAS, Louisiana must develop and implement a community sewerage system 3 accountability process which supports sewerage system infrastructure sustainability for the 4 residents of Louisiana; and 5 WHEREAS, there should be a system of accountability for local government 6 authorities and other entities operating community sewerage systems and potential 7 consequences for community sewerage systems that do not achieve state and federal 8 standards; and 9 WHEREAS, there must be transparent regulatory compliance and fiscal 10 accountability information presented to the State Bond Commission, the division of 11 administration, and rate setting authorities for consideration in approving additional debt, 12 capital outlay appropriations, or a rate increase. 13 THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana 14 does hereby urge and request the State Bond Commission, the division of administration, 15 and rate setting authorities to request and consider an applicant's sewerage system 16 compliance status with the Louisiana Department of Health and the Department of 17 Environmental Quality and financial status with the legislative auditor as a component of 18 their review process. 19 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 20 State Bond Commission, division of administration, and Public Service Commisison.
