SLS 23RS-237 ORIGINAL 2023 Regular Session SENATE RESOLUTION NO. 5 BY SENATOR FOIL CRIMINAL PROCEDURE. Creates the Protective Order Procedure and Records Task Force. 1 A RESOLUTION 2 To create and provide for the Protective Order Procedure and Records Task Force. 3 WHEREAS, protective orders have been mainstays in preventing domestic abuse and 4 sexual assault in Louisiana for decades; and 5 WHEREAS, protective orders are statistically more likely to protect women from 6 becoming victims of abuse and violence committed by male partners, and the FBI estimates 7 that eighty-two percent of partner violence victims are female; and 8 WHEREAS, the National Crime Victimization Survey indicates that no matter the 9 rate of violence by gender, women are seven to ten times more likely than men to be injured; 10 and 11 WHEREAS, Louisiana's criminal justice system must protect women and children 12 as swiftly and efficiently as possible; and 13 WHEREAS, it has been reported that oftentimes charges initiating a protective order 14 are dropped but the order stays in the system, causing confusion as to whether the protective 15 order should be enforced; and 16 WHEREAS, further study is needed to improve the process of creating and 17 dismissing a protective order to better protect Louisiana families. 18 THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana Page 1 of 3 SR NO. 5 SLS 23RS-237 ORIGINAL 1 does hereby establish and provide for the Protective Order Procedure and Records Task 2 Force to study the best methods to ensure protective order records are kept properly and 3 efficiently, and to propose recommendations, together with specific proposals for legislation, 4 if any proposals or recommendations are deemed necessary by the task force, by written 5 report to the Senate and to the David R. Poynter Legislative Research Library as required 6 by R.S. 24:771 and 772, no later than March 1, 2024. 7 BE IT FURTHER RESOLVED that the task force shall consist of the following 8 members: 9 (1) The president of the Louisiana Sheriffs' Association, or his designee, who will 10 serve as chair. 11 (2) The director of the Louisiana Protective Order Registry, or her designee. 12 (3) A designee from the Louisiana Supreme Court, appointed by the chief justice. 13 (4) The president of the Louisiana Clerks of Court Association, or his designee. 14 (5) A designee from the Louisiana District Attorneys Association, appointed by the 15 executive director. 16 BE IT FURTHER RESOLVED that each designating authority shall submit the 17 names of designees to the task force to the president of the Louisiana Sheriffs' Association 18 no later than July 31, 2023. 19 BE IT FURTHER RESOLVED that the task force shall convene for its first meeting 20 no later than October 31, 2023, at the call of the chair, and at the first meeting, the members 21 shall elect other officers as the task force may deem appropriate. 22 BE IT FURTHER RESOLVED that the task force shall receive staff support from 23 the Louisiana Sheriffs' Association. 24 BE IT FURTHER RESOLVED that a majority of the task force shall constitute a 25 quorum for the transaction of business, and all official actions of the task force shall require 26 the affirmative vote of a majority of the members. 27 BE IT FURTHER RESOLVED that the members of the task force shall serve 28 without compensation, except per diem or expenses reimbursement to which they may be 29 individually entitled as members of their constituent organizations. 30 BE IT FURTHER RESOLVED that the task force shall terminate on the date of the Page 2 of 3 SR NO. 5 SLS 23RS-237 ORIGINAL 1 submission of its report, if any, or March 1, 2024, whichever occurs first. 2 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 3 Louisiana Sheriffs' Association, the Louisiana Protective Order Registry, the Louisiana 4 Supreme Court, the Louisiana Clerks of Court Association, and the Louisiana District 5 Attorneys Association. (5)A designee from the La. District Attorneys Association, designated by the executive director. Provides relative to meetings of the task force, quorum, and voting.
