RÉSUMÉ DIGEST ACT 65 (HB 138) 2024 Regular Session Schlegel Existing law provides for elements designated as a crime of nonconsensual disclosure of a private image and provides exceptions. Prior law provided for the application of the existing law offense to people 17 years of age or older. New law eliminates the requirement that the victim be 17 years of age or older. Prior law required the person who disclosed the image to have the intent to cause harm or emotional distress to the victim. New law eliminates the specific intent to harass or cause emotional distress requirement. Prior law provided that disclosure of an image when the person depicted in the image voluntarily or knowingly exposed his or her intimate parts in a public setting did not constitute the offense of nonconsensual disclosure of a private image. New law applies this exception to a person engaged in sexual conduct in a public setting. New law defines "sexual conduct". Effective August 1, 2024.
