HOUSE BILL NO. 149

ALCOHOLIC BEVERAGES:  Provides for the sale of certain alcoholic beverages in the
town of Winnsboro
1	AN ACT
2To amend and reenact R.S. 26:494, relative to the regulation of alcoholic beverages in
3 parishes and municipalities; to provide relative to the sale of certain alcoholic
4 beverages in the town of Winnsboro; and to provide for related matters.
5	Notice of intention to introduce this Act has been published
6	as provided by Article III, Section 13 of the Constitution of
7	Louisiana.
8Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 26:494 is hereby amended and reenacted to read as follows: 
10 ยง494.  Sale of beverages of high alcoholic content in violation of local ordinance 
11	A.  No person shall sell any beverages of high alcoholic content in violation
12 of any lawful ordinance or regulation adopted by authority of this Part by any parish
13 or municipality.
14	B.  Notwithstanding the provisions of Subsection A of this Section, in the
15 town of Winnsboro, a restaurant establishment whose average monthly revenue from
16 the sale of food and nonalcoholic beverages equals or exceeds eighty percent may
17 sell beverages of high alcoholic content until 11:00 p.m. each day of operation.

Abstract:  Permits the sale of certain alcoholic beverages in certain restaurant
establishments in the town of Winnsboro.
Present law provides that no person shall sell any beverage of high alcoholic content in
violation of any lawful ordinance adopted by a parish or municipality.
Proposed law exempts restaurant establishments in the town of Winnsboro that gain at least
80% of their average monthly revenue from the sale of food and permits the sale of 
beverages of high alcoholic content in those establishments until 11:00 p.m. each day of
operation.
