R.S. 33:9039.15.1 and 9039.16(D) are hereby enacted to read as follows: 14 §9039.15.1. Lakeshore Villages Community Development District; board of 15 supervisors, elections, and meetings 16 The Lakeshore Villages Community Development District in St. Tammany 17 Parish, hereafter in this Section referred to as the "district", is subject to the 18 provisions of R.S. 33:9039.15 except as otherwise provided by this Section: 19 (1)(a) District supervisors shall be elected on the date specified by R.S. 20 18:402 for congressional elections, and their terms shall begin on January third of Page 1 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 24RS-111 ORIGINAL HB NO. 152 1 the year after the election. Each supervisor shall be elected to a designated division 2 of the board. The divisions are for the sole purpose of election of supervisors. The 3 divisions are designated alphabetically as Divisions "A" through "E", and each 4 supervisor in office on January 1, 2015, shall be assigned to a designated division by 5 name alphabetically. A candidate for supervisor shall, at the time of filing his 6 declaration as a candidate therefor, designate only one division for which he is a 7 candidate. The electors of the district shall elect one member from among the 8 candidates for each division of the commission. 9 (b) Notwithstanding Subparagraph (a) of this Paragraph, if the total number 10 of registered voters in the district is fewer than two hundred fifty in any even- 11 numbered year, no election shall be held in that year, and the governing authority of 12 St. Tammany Parish shall appoint the successors to supervisors whose terms expire 13 on January third of the following year. By April fifteenth of each even-numbered 14 year, the chief executive officer of the district shall request from the registrar of 15 voters a report on the number of registered voters in the district. By June fifteenth 16 of the year, the board of supervisors shall decide whether to call an election or 17 request that the parish governing authority appoint such members. 18 (2)(a) Except as otherwise provided by this Paragraph, district supervisors 19 serve four-year terms. 20 (b) The terms of all supervisors serving on January 1, 2025, end on 21 January 3, 2027. The initial term of three supervisors elected at the election in 2026 22 is four years and the initial term for two supervisors is two years, as determined by 23 lot at the first meeting of the board after the beginning of the term. 24 (3) The district's board of supervisors shall elect one supervisor as chair and 25 one supervisor as a vice chair. The board shall also elect a secretary who need not 26 be a supervisor and who may also serve as the treasurer as provided in R.S. 27 33:9039.16(B). The board may elect other officers as it deems necessary. 28 (4) Each district supervisor may receive a per diem of not more than two 29 hundred fifty dollars for meetings he attends, but not more than two meetings per Page 2 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. The board of supervisors of the Lakeshore Villages Community 6 Development District in St. Tammany Parish may contract, on terms it deems 7 appropriate, with a person or entity to provide financial services and record keeping 8 services for the district. 9 Section 2. Present law authorizes parish governing authorities, pursuant to a petition from landowners, to create community development districts. Present law authorizes a community development district to finance, fund, plan, establish, acquire, construct or reconstruct, enlarge or extend, equip, operate, and maintain systems, facilities, and basic infrastructures for the following: (1)Water management and control. (2)Water supply, sewer, and wastewater management. (3)Bridges or culverts. (4)Roads and street lights. With approval of the parish, a community development district may also plan, establish, acquire, construct or reconstruct, enlarge or extend, equip, operate, and maintain systems and facilities for: (1)Parks and facilities for recreational, cultural, and educational uses. (2)Fire prevention and control. (3)School buildings and related structures. (4)Security. (5)Control and elimination of mosquitoes and other public health nuisances. (7)Revenue producing utilities except electricity and gas services. Present law provides for governance of such a district by a board of supervisors. Proposed law amends present law as it pertains to the supervisors of the Lakeshore Villages Community Development District in St. Tammany Parish (the Lakeshore district) as follows: (1)Present law provides that supervisors are qualified electors of the district elected by the qualified electors of the district in accordance with the La. Election Code. Proposed law additionally requires that Lakeshore district supervisors be elected on the dates provided for congressional elections. (2)Present law provides that supervisors are appointed by the parish governing authority if the district's population is less than 600 persons. Proposed law provides that the St. Tammany parish governing authority will appoint Lakeshore district supervisors whose terms expire in an election year if the total number of registered voters in the district is fewer than 250 that year. (3)Present law provides that supervisors serve four-year terms. Proposed law extends the terms of current supervisors and provides for the election of all five supervisors in 2026; provides for staggered terms thereafter. (4)Present law requires the board to select a supervisor as chair and to elect a secretary, who need not be a supervisor, and such other officers as the board deems necessary. Proposed law also requires the Lakeshore district to elect a supervisor as vice chair and authorizes the elected secretary to serve as treasurer. (5)Present law authorizes supervisors to receive per diem not to exceed $75 per meeting. Proposed law authorizes Lakeshore district supervisors to receive a per diem not to exceed $250 per meeting for not more than two meetings per month Proposed law authorizes the Lakeshore district to contract for financial services and record keeping services.
