ENROLLED ACT No. 414 2024 Regular Session HOUSE BILL NO. 152 BY REPRESENTATIVE BERAULT 1 AN ACT 2 To enact R.S. 33:9039.15.1 and 9039.16(D), relative to the Lakeshore Villages Community 3 Development District in St. Tammany Parish; to provide relative to the election of 4 the district's governing authority and terms of members; to provide for appointment 5 of members under certain circumstances; to provide relative to compensation of 6 members of the governing authority; to provide relative to officers; to authorize the 7 district to contract for financial and record keeping services; to provide for an 8 effective date; and to provide for related matters. 9 Notice of intention to introduce this Act has been published 10 as provided by Article III, Section 13 of the Constitution of 11 Louisiana. 12 Be it enacted by the Legislature of Louisiana: 13 Section 1. R.S. 33:9039.15.1 and 9039.16(D) are hereby enacted to read as follows: 14 §9039.15.1. Lakeshore Villages Community Development District; board of 15 supervisors, elections, and meetings 16 The Lakeshore Villages Community Development District in St. Tammany 17 Parish, hereafter in this Section referred to as the "district", is subject to the 18 provisions of R.S. 33:9039.15 except as otherwise provided by this Section: 19 (1)(a) District supervisors shall be elected on the date specified by R.S. 20 18:402 for congressional elections, and their terms shall begin on January third of 21 the year after the election. HB NO. 152 ENROLLED 1 of the board. The divisions are for the sole purpose of election of supervisors. The 2 divisions are designated alphabetically as Divisions "A" through "E", and each 3 supervisor in office on January 1, 2025, shall be assigned to a designated division by 4 name alphabetically. A candidate for supervisor shall, at the time of filing his 5 declaration as a candidate therefor, designate only one division for which he is a 6 candidate. The electors of the district shall elect one member from among the 7 candidates for each division of the commission. 8 (b) Notwithstanding Subparagraph (a) of this Paragraph, if the total number 9 of registered voters in the district is fewer than two hundred fifty in any even- 10 numbered year, no election shall be held in that year, and the governing authority of 11 St. Tammany Parish shall appoint the successors to supervisors whose terms expire 12 on January third of the following year. By April fifteenth of each even-numbered 13 year, the chief executive officer of the district shall request from the registrar of 14 voters a report on the number of registered voters in the district. By June fifteenth 15 of the year, the board of supervisors shall decide whether to call an election or 16 request that the parish governing authority appoint such members. 17 (2)(a) Except as otherwise provided by this Paragraph, district supervisors 18 serve four-year terms. 19 (b) The terms of all supervisors serving on January 1, 2025, end on 20 January 3, 2027. The initial term of three supervisors elected at the election in 2026 21 is four years and the initial term for two supervisors is two years, as determined by 22 lot at the first meeting of the board after the beginning of the term. 23 (3) The district's board of supervisors shall elect one supervisor as chair and 24 one supervisor as a vice chair. The board shall also elect a secretary who need not 25 be a supervisor and who may also serve as the treasurer as provided in R.S. 26 33:9039.16(B). The board may elect other officers as it deems necessary. 27 (4) Each district supervisor may receive a per diem of not more than two 28 hundred fifty dollars for meetings he attends, but not more than two meetings per 29 month. Each supervisor may also receive travel expenses as authorized in the 30 district's bylaws. The board of supervisors of the Lakeshore Villages Community 4 Development District in St. Tammany Parish may contract, on terms it deems 5 appropriate, with a person or entity to provide financial services and record keeping 6 services for the district. 7 Section 2. This Act shall become effective on January 1, 2025.
