DISTRICT ATTORNEYS/ASST:  Provides relative to the salaries of assistant district
attorneys
1	AN ACT
2To amend and reenact R.S. 16:11(A)(2), relative to the annual salary of assistant district
3 attorneys payable by the state; to provide relative to reallocation by all judicial
4 districts; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 16:11(A)(2) is hereby amended and reenacted to read as follows: 
7 ยง11.  Annual salary of assistant district attorneys payable by state

10	(2)  Notwithstanding the provisions of R.S. 16:51(A)(19), (23), (32), and (38)
11 to the contrary, the district attorney attorneys for the parish of Orleans and the
12 Nineteenth, Twenty-Third, and the Thirty-Second Judicial Districts all judicial
13 districts may reallocate by combining or dividing the total amount fixed in Paragraph
14 (1) of this Subsection to pay the salaries of any of his other assistant district attorneys
15 in any lawful manner he deems appropriate. The district attorney shall certify to the
16 state treasurer the amount of the annual salary payable upon warrant for each of his
17 assistant district attorneys provided for in R.S. 16:51(A)(19), (23), (32), and (38).

Abstract: Permits district attorneys to fix the salaries of assistant district attorneys. 
Present law provides for a minimum number of assistant district attorneys in each judicial
district and in the parish of Orleans, and further provides for a fixed total salary amount per
assistant district attorney which the state treasurer may pay upon the warrant of each
assistant district attorney. 
Present law provides that, notwithstanding the minimum number of assistant district
attorneys permitted under present law in Orleans Parish and in the 19th Judicial District, the
district attorney for the parish of Orleans and the 19th Judicial District may reallocate by
combining or dividing the fixed total amount of annual salary permitted to be paid to all
assistant district attorneys in that jurisdiction in any lawful manner the district attorney
deems appropriate.  Present law further provides that the district attorney in Orleans Parish
and the 19th Judicial District shall certify to the state treasurer the amount of annual salary
payable upon warrant for each of his assistant district attorneys.
Proposed law permits all judicial districts to reallocate by combining or dividing the fixed
total amount of annual salaries permitted to be paid to all assistant district attorneys in any
lawful manner the district attorney deems appropriate.
