MEDICAL MARIJUANA: Provides relative to the regulation of medical marijuana
1 AN ACT
2To amend and reenact R.S. 40:1046(H)(2)(a) and (L), relative to the production of
3 therapeutic marijuana; to provide for the research of therapeutic marijuana; to extend
4 the termination date; to provide for an effective date; and to provide for related
5 matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 40:1046(H)(2)(a) and (L) are hereby amended and reenacted to read
8as follows:
9 ยง1046. Recommendation and dispensing of marijuana for therapeutic use; rules and
10 regulations of the Louisiana Board of Pharmacy; production facility
11 licensing; permitting by the Louisiana Department of Health

15 (2) The Louisiana Department of Health shall issue all of the following
16 annually:
17 (a) A nontransferable specialty license for the production and research of
18 recommended marijuana for therapeutic use, which the department shall issue only
19 to the Louisiana State University Agricultural Center and the Southern University
20 Agricultural Center.

2 L. The provisions of this Section shall terminate on January 1, 2025 July 1,
3 2030.
4 Section 2. This Act shall become effective upon signature by the governor or, if not
5signed by the governor, upon expiration of the time for bills to become law without signature
6by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
7vetoed by the governor and subsequently approved by the legislature, this Act shall become
8effective on the day following such approval.

Abstract: Provides relative to the regulation of therapeutic marijuana.
Present law requires the La. Dept. of Health to grant licenses to produce therapeutic
marijuana only to the Louisiana State University Agricultural Center and the Southern
University Agricultural Center.
Proposed law retains present law and adds that the license granted to the universities permits
only the Louisiana State University of Agricultural Center and the Southern University
Agricultural Center to conduct research on therapeutic marijuana.
Present law terminates the provisions of the therapeutic marijuana program on Jan. 1, 2025.
Proposed law extends the termination date to July 1, 2030.
Effective upon signature of governor or lapse of time for gubernatorial action.
