HOUSE BILL NO. 421

HEALTH CARE/RECORDS:  Requires healthcare providers to document a diagnosis of
sickle cell disease on immunization records in certain circumstances
1	AN ACT
2To enact R.S. 40:31.12(3)(h), relative to immunization records; to report a sickle cell disease
3 diagnosis in certain circumstances; to establish procedures to obtain patient consent
4 prior to reporting; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 40:31.12(3)(h) is hereby enacted to read as follows: 
7 ยง31.12.  Definitions
8	As used in this Part, the following definitions shall apply:

10	(3)  "Immunization record" means a client's medical record related to the
11 client's receipt of immunizations.  An immunization record shall only include:

13	(h)  A healthcare provider's certification of a sickle cell disease diagnosis. 
14 A provider shall obtain the consent of a client or the parent or guardian of a client
15 under the age of eighteen prior to documenting any medical condition on the client's
16 immunization record.

Abstract:  Directs a healthcare provider to document a preexisting sickle cell disease
diagnosis on a patient's immunization record.
Present law requires the Louisiana Department of Health to maintain a record of all
immunizations an individual receives. 
Proposed law provides a location for healthcare providers to designate a sickle cell disease
diagnosis after obtaining the consent of the patient or, if the patient is a minor, the consent
of the patient's parent or guardian.
