HOUSE BILL NO. 484

CREDIT/CARDS:  Provides relative to surcharges for credit card use
1	AN ACT
2To enact R.S. 9:3518.5, relative to credit card surcharge fees; to prohibit certain excess fees;
3 to provide for liability; and to provide for related matters.
4Be it enacted by the Legislature of Louisiana:
5 Section 1. R.S. 9:3518.5 is hereby enacted to read as follows: 
6 ยง3518.5.  Credit card surcharge fee; prohibiting certain excess fees; liability
7	A.  Any retail business that adds a surcharge onto a purchase when a
8 consumer uses a credit or debit card shall not charge a surcharge amount that is
9 greater than the amount the business pays to process the transaction.
10	B.  A retail business that violates the provisions of this Section shall be liable
11 to the cardholder for any damages or expenses, or both, which the cardholder incurs.
12	C.  As used in this Section:
13	(1)  "Cardholder" has the meaning ascribed to it in R.S. 9:3518.3.
14	(2)  "Surcharge" means any additional amount of money imposed at the time
15 of the transaction by a retail business which increases the charge to the consumer for
16 the privilege of using a credit or debit card.

Abstract:  Prohibits a business from charging a debit or credit cardholder certain excess
card usage fees.
Proposed law provides that a retail business shall not charge a surcharge or credit card
processing amount greater than the amount the business pays to process the transaction.
Proposed law provides that a retail business in violation of proposed law shall be liable to
the credit or debit cardholder.
Proposed law defines "cardholder" and "surcharge".
