HLS 24RS-315 REENGROSSED 2024 Regular Session HOUSE BILL NO. 51 BY REPRESENTATIVE DEWITT COURTS/COURT COSTS: Increases the fees for the Alexandria City Marshal in criminal matters 1 AN ACT 2To amend and reenact R.S. 13:2090, relative to the marshal of the city court of Alexandria; 3 to authorize the city marshal to collect an appearance bond fee; to provide relative 4 to the city marshal's general fund; to provide for effectiveness; and to provide for 5 related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 13:2090 is hereby amended and reenacted to read as follows: 8 ยง2090. Alexandria, deputy marshal Alexandria; marshal; fees in criminal matters; 9 deputy marshal 10 A. The marshal of the city court of Alexandria shall collect a fee of thirty 11 dollars for taking an appearance bond when required to do so. 12 B. The sums of monies collected under the provisions of Subsection A of 13 this Section shall be deposited in the marshal's general fund to supplement the 14 operational expenses of the marshal's office. The expenditure of the funds shall be 15 at the sole discretion of the marshal of the court. All funds shall be subject to and 16 included in the marshal's annual audit. A copy of the audit shall be filed with the 17 legislative auditor who shall make it available for public inspection. 18 C. The assessment and disposition of any funds pursuant to this Section shall 19 not affect responsibilities of the city and parish governing authorities provided by 20 law for the financing of the marshal's office of the Alexandria City Court. The marshal of the city court of Alexandria, with the approval of the 2 judge of the city court of Alexandria, is authorized to employ a deputy marshal at an 3 annual minimum salary of three thousand dollars, to be paid monthly on his own 4 warrant in equal proportions by the city of Alexandria and the parish of Rapides. 5 Section 2. In accordance with the provisions of R.S. 13:62, the change in court costs 6or fees as provided by this Act shall become effective if and when the Judicial Council 7provides a recommendation that such court costs or fees meet the applicable guidelines in 8its report to the Louisiana Legislature. Present law provides for the collection of marshals' fees and costs in criminal matters in certain city courts. Present law (R.S. 13:2074.4) authorizes the city marshal of Hammond to collect a fee of $20 for taking an appearance bond. Proposed law authorizes the city marshal of Alexandria to collect a fee of $30 for taking an appearance bond in order to supplement the operational expenses of the marshal's office.
