HOUSE BILL NO. 538

PUBLIC LANDS/STATE:  Authorizes the transfer of certain state property in St. Martin
parish
1	AN ACT
2To authorize and provide for the transfer of certain state property; to authorize the transfer
3 of certain state property in St. Martin Parish; to provide for property descriptions; to
4 provide for the reservation of mineral rights; to provide terms and conditions; to
5 provide for an effective date; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  The commissioner of administration, through the office of state lands,
8notwithstanding any other provision of law to the contrary, is hereby authorized and
9empowered to convey, transfer, assign, lease, or deliver any interest, excluding mineral
10rights, the state may have in and to all or any portion of the following described property in
11St. Martin Parish to Michael Marks:
12 A parcel of land situated in Section 11, Township 9 South, Range 7 East, St. Martin
13 Parish, comprised of approximately 0.101 acres, bounded on the North by property
14 owned by Michael Marks & Phyllis Dwyer Marks and bounded on the South by
15 approximately 0.101 acres of property owned now or formerly by the State.
16 Section 2.  The commissioner of administration, through the office of state lands, is
17hereby authorized to enter into such agreements, covenants, conditions, and stipulations and
18to execute such documents as necessary to properly effectuate any conveyance, transfer,
19assignment, lease, or delivery of any interest, excluding mineral rights, to the property
20described in Section 1 of this Act, and as more specifically described in any such agreements
21entered into and documents executed by and between the commissioner of administration
22and Michael Marks, in exchange for consideration proportionate to the appraised value of
23the property.

1 Section 3.  The commissioner of administration, through the office of state lands,

5St. Martin Parish to Scott Christopher Noel:
6 A parcel of land situated in Section 11, Township 9 South, Range 7 East, St. Martin
7 Parish, comprised of approximately 0.101 acres, bounded on the North by
8 approximately 0.101 acres of property owned now or formerly by the State and
9 bounded on the Southeast by property owned by Scott Christopher Noel & Racheal
10 G. Noel.
11 Section 4.  The commissioner of administration, through the office of state lands, is
12hereby authorized to enter into such agreements, covenants, conditions, and stipulations and
13to execute such documents as necessary to properly effectuate any conveyance, transfer,
14assignment, lease, or delivery of any interest, excluding mineral rights, to the property
15described in Section 3 of this Act, and as more specifically described in any such agreements
16entered into and documents executed by and between the commissioner of administration
17and Scott Christopher Noel, in exchange for consideration proportionate to the appraised
18value of the property.
19 Section 5.  This Act shall become effective upon signature by the governor or, if not
20signed by the governor, upon expiration of the time for bills to become law without signature
21by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
22vetoed by the governor and subsequently approved by the legislature, this Act shall become
23effective on the day following such approval.
