HOUSE BILL NO. 540

FISHING/COMMERCIAL:  Provides for eligibility of charter boat fishing guides for the
Fisherman's Gear Compensation Fund
1	AN ACT
2To amend and reenact R.S. 30:101.9(D)(5), relative to the Fishermen's Gear Compensation
3 and Underwater Obstruction Removal Dedicated Fund Account; to provide for
4 disbursement and expenditure of monies in the account; to provide for eligible
5 claimants; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 30:101.9(D)(5) is hereby amended and reenacted to read as follows:
8 ยง101.9.  Fishermen's Gear Compensation and Underwater Obstruction Removal

13	(5)  Payment of any fully justified claim made in accordance with procedures
14 established in this Section for actual damages suffered by a commercial or charter
15 boat fisherman as a result of hitting or snagging an obstruction or hazard in the
16 waters of the state resulting from natural occurrences, oil and gas activities, or other
17 activities where the owner of the obstruction is unknown.

Abstract:  Makes charter boat fishermen eligible for compensation from the Fishermen's
Gear Compensation and Underwater Obstruction Removal Dedicated Fund Account.
Present law establishes the Fishermen's Gear Compensation and Underwater Obstruction
Removal Dedicated Fund Account.  Specifies that the account is used to compensate
commercial fishermen for damages they suffer due to obstructions or hazards from natural
occurrences, oil and gas activities, or other activities where the obstruction is unknown.
Proposed law retains present law and adds charter boat fishermen as eligible claimants for
compensation from the fund.
