HOUSE BILL NO. 553

CRIMINAL/RECORDS:  Provides relative to the disposition of certain records for
seventeen year old offenders
1	AN ACT
2To enact Code of Criminal Procedure Article 999, relative to expungement; to provide for
3 the expungement of arrest records for certain individuals; and to provide for related
4 matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  Code of Criminal Procedure Article 999 is hereby enacted to read as
7follows: 
8 Art. 999.  Expungement of arrest records for certain individuals
9	A  person shall be entitled to the automatic expungement of his arrest, at no
10 cost to him, if he meets all of the following:
11	(1)  He is seventeen years of age when he is arrested or charged with any
12 criminal offense as provided in Title 14 of the Louisiana Revised Statues of 1950.
13	(2)  The charge forming the basis for his arrest is subsequently dismissed or
14 has been charged by an entry of a nolle prosequi.

Abstract: Provides relative to the expungement of arrest records for certain offenders.
Proposed law provides that a person shall be entitled to the automatic expungement of his
arrest, at no cost to him, if he meets all of the following:
(1)He is 17 years of age when he is arrested or charged with any criminal offense as
provided in present law (Title 14 of the La. Rev. Statues of 1950).
(2)The charge forming the basis for his arrest is subsequently dismissed or has been
charged by an entry of a nolle prosequi.
