The Section heading of R.S. 33:4071 is hereby amended and reenacted 12and R.S. 33:4070 is hereby enacted to read as follows: 13 §4070. Creation of sewerage and water board 14 A. The public water system, the public sewerage system, and the public 15 drainage system of the city of New Orleans shall be constructed, controlled, 16 maintained, and operated by a sewerage and water board. The board shall be 17 comprised of the seven members of the governing authority of New Orleans. 18 B. A quorum of the board shall adopt rules fixing its own meetings and 19 procedures. Any amendments or changes to such rules shall be adopted only after 20 approved by a quorum of the board. R.S. 33:4071(A) through (E) are hereby repealed in their entirety. 5 Section 3.(A) The provisions of this Act shall take effect and become operative on 6the first day of January following an election at which a majority of the voters of the city of 7New Orleans approve an amendment to Article V, Chapter 3, Section 5-301 of the home rule 8charter of the city to change the composition of the Sewerage and Water Board of New 9Orleans to provide the identical composition of the board as contained in this Act. 10 (B) The terms of the members of the Sewerage and Water Board of New Orleans in 11office on the first day of January as provided in Subsection (A) of this Section shall 12terminate on that date. Present law provides that the public water, sewerage, and drainage systems of the city of New Orleans shall be constructed, controlled, maintained, and operated by the sewerage and water board of New Orleans. Proposed law retains present law. Present law provides that the board shall be composed as follows: (1)The mayor. (2)The chair of the Public Works, Sanitation and Environment Committee of the New Orleans city council, a member of the committee appointed by the chair, or a civil engineer appointed by the chair. (2)Two syndicate members of the board of liquidation, city debt, to be appointed by the mayor on the recommendation of the board of liquidation, city debt. (3)Seven citizens, to be appointed by the mayor, with the advice and consent of the city council from a list of nominees submitted by the sewerage and water board selection committee. Present law requires citizen members to be registered voters in Orleans Parish and to have been a domiciliary of the parish for two years previous to their appointment. HLS 24RS-249 ORIGINAL HB NO. 569 requires that vacancies occurring in mayoral appointments be filled in the manner of the original appointment. Present law provides that no person who is a stockholder or bondholder in any sewerage or waterworks company or who holds any public office yielding emoluments to the holder other than those specified in present law shall be eligible for appointment to the board. Proposed law removes present law and instead provides that the board shall be comprised of the seven members of the governing authority of New Orleans. Proposed law provides that the provisions of proposed law shall take effect and become operative on the first day of Jan. following an election where a majority of the voters of the city of New Orleans approve an amendment to the home rule charter of the city to change the composition of the board to provide the identical composition of the board as contained in proposed law. Further provides that the terms of members of the board in office on the first day of Jan. shall terminate on that date.
