SSHB695 4468 4820 HOUSE SUMMARY OF SENATE AMENDMENTS HB 695 2024 Regular Session Fontenot TRANSPORTATION: Creates an overweight permit to transport earthen material for government funded levee projects Synopsis of Senate Amendments 1.Makes technical changes. 2.Clarifies that the secretary must issue a per project special overweight permit for each truck transporting earthen materials for government funded levee projects. 3.Clarifies that the per project special oversight permit must authorize the operation of the vehicle or straight truck at a gross weight not to exceed seventy thousand pounds for which twenty-two thousand pounds for steering axle and forty-eight thousand pounds for tridum group while operating on any state- maintained highway except on the interstate system. 4.Clarifies that the secretary must impose a penalty for each violation of the weight permit pursuant to present law, instead of authorizing a civil penalty of up to one cent per pound for each weight limit violation. 5.Establishes an annual special permit that authorizes a ten percent weight variance for trucks and trailers hauling raw input materials for concrete and finished concrete products. 6.Establishes an annual special permit that authorizes a twelve percent weight variance for single unit dump trucks. Digest of Bill as Finally Passed by Senate Proposed law establishes a per project special overweight permit for each truck transporting earthen materials for government funded levee projects. Proposed law specifies that the permit is valid for one year from the date of issuance. Proposed law requires that the permit be issued in accordance with the following provisions: (1)The applicant for the special permit must designate the specific routes to be utilized for transporting the earthen materials and identify the project for which they are transporting materials upon application. (2)The permit fee is $1,000 per project. Requires a new permit if the project exceeds the one-year validity of the project. (3)The vehicle or straight truck must not exceed a gross weight of 70,000 lbs. for which 22,000 lbs. for a steering axle and 48,000 lbs. for tridum group while operating on any state-maintained highway, except on the Interstate system. Proposed law requires the secretary to impose a penalty for each violation of the weight limit established by present law. Proposed law defines "earthen materials" as materials which include minerals, rocks, and soil. Authorizes the secretary to issue annual permits for a fee of $400 per unit that prohibits both gross and axle weight penalties when the total excess weight is 10% or less. Proposed law establishes a special permit relating only to single unit dump-trucks and with no limitation as to the material being hauled. Authorizes the secretary to issue annual special permits for a fee of $800 per truck when the total excess weight is 12% or less of the truck's maximum permissible gross weight. Proposed law authorizes the secretary of the department to promulgate rules and regulations as are necessary to enforce the provisions of proposed law. Proposed law specifies that nothing contained in proposed law preempts municipal or parish ordinances from regulating weight limits on municipal or parish streets or roads.
