HLS 24RS-1190 REENGROSSED 2024 Regular Session HOUSE BILL NO. 744 BY REPRESENTATIVE GLORIOSO RETIREMENT/MUNICIPAL EMP: Provides relative to part-time reemployment of retirees in the Municipal Employees' Retirement System 1 AN ACT 2To amend and reenact R.S. 11:1762(A), relative to the Municipal Employees' Retirement 3 System; to provide relative to the retirement benefit of retirees who return to part- 4 time employment in a position covered by the system; and to provide for related 5 matters. 6 Notice of intention to introduce this Act has been published 7 as provided by Article X, Section 29(C) of the Constitution 8 of Louisiana. 9Be it enacted by the Legislature of Louisiana: 10 Section 1. R.S. 11:1762(A) is hereby amended and reenacted to read as follows: 11 ยง1762. Part-time reemployment of retirees 12 A.(1) Whenever a retiree receiving normal retirement benefits becomes 13 reemployed by an employer but he does not meet the definition of an employee and 14 either his monthly earnings are equal to or less than the difference between his 15 monthly average final compensation and his monthly retirement benefit or he has 16 more than thirty years of creditable service, his retirement benefits shall continue 17 without any reduction and he shall not be a member of the system. 18 (2) Whenever a retiree who has thirty years or less of creditable service and 19 who is receiving normal retirement benefits becomes reemployed by an employer but 20 he does not meet the definition of an employee and his monthly earnings exceed the Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 24RS-1190 REENGROSSED HB NO. 744 1 difference between his monthly average final compensation and his monthly 2 retirement benefit, his retirement benefits shall be reduced by the amount his 3 monthly earnings exceed the difference between his monthly average final 4 compensation and his monthly retirement benefit for every month of such 5 employment and he shall not be a member of the system. [R.S. 1:13(B) and 24:177(E)] HB 744 Reengrossed 2024 Regular Session Glorioso Abstract: Provides relative to reemployed retirees of the Municipal Employees' Retirement System (MERS). Present law requires a reduction of retirement benefits for a MERS retiree who is reemployed part time (less than an average of 35 hours per week) in a position covered by MERS if his monthly earnings exceed the difference between his monthly average final compensation and his monthly retirement benefit. Provides that the benefit is reduced by the amount his monthly earnings exceed the difference between his monthly average final compensation and his monthly retirement benefit. Further provides for an annual adjustment to the base amount which triggers the reduction. Proposed law provides that a person who retired with more than 30 years of services is not subject to the benefit reduction. Present law provides that such an employee is not a member of the system. Provides that during such redeployment, if first redeployment occurs on or after July 1, 2016, the retiree and the employer make contributions to the retirement system. Authorizes the employee, upon termination of redeployment, to receive a refund of his contributions but provides that he shall receive no additional service credit or additional retirement benefit.
