1 AN ACT
2 To amend and reenact R.S. 11:1762(A), relative to the Municipal Employees' Retirement
3 System; to provide relative to the retirement benefit of retirees who return to part-
4 time employment in a position covered by the system; to provide for an effective
5 date; and to provide for related matters.
6 Notice of intention to introduce this Act has been published
7 as provided by Article X, Section 29(C) of the Constitution
8 of Louisiana.
9 Be it enacted by the Legislature of Louisiana:
10 Section 1. R.S. 11:1762(A) is hereby amended and reenacted to read as follows:
11 ยง1762. Part-time reemployment of retirees
12 A.(1) Whenever a retiree receiving normal retirement benefits becomes
13 reemployed by an employer but he does not meet the definition of an employee and
14 either his monthly earnings are equal to or less than the difference between his
15 monthly average final compensation and his monthly retirement benefit or he has
16 more than thirty years of creditable service and is at least age sixty, his retirement
17 benefits shall continue without any reduction and he shall not be a member of the
18 system.
19 (2) Whenever a retiree who has thirty years or less of creditable service and
20 who is receiving normal retirement benefits becomes reemployed by an employer but
21 he does not meet the definition of an employee and his monthly earnings exceed the
22 difference between his monthly average final compensation and his monthly

1 retirement benefit, his retirement benefits shall be reduced by the amount his
2 monthly earnings exceed the difference between his monthly average final
3 compensation and his monthly retirement benefit for every month of such
4 employment and he shall not be a member of the system. The calculation of monthly
5 earnings shall not include income attributable to service as a part-time elected
6 official listed in R.S. 11:164.

8 Section 2. The provisions of this Subsection shall terminate on June 30, 2028.
